Benefits if Separated from the company

Hello. I am currently working in a BPO company for four years now. Unfortunately, a bad call was audited early this month in which I have unintentionally raised my voice to the customer. So I got a call out for being overtly rude. I was issued show cause memo this Monday and was asked to submit written explanation in 5 days which I am now working on. Next Monday will be our hearing. Worst case scenario, if ever I will be separated from the company next week because of this, what are the benefits mandated by law that I will still get? Will I be refunded the tax that I have paid for this year (if I wont be able to stay with the company until the end of the year)? Thank you.

You should receive:

1. unpaid salaries
2. pro-rated 13th month pay
3. tax refund - not the full amount of taxes that was withheld but only the excess.
4. other company benefits that may be due

I currently have SSS loan and is being paid through salary deduction. I understand that the final pay will be used to cover the remaining loan balance. For example, I have received my 13th month pay today including the salary of the recent pay period but got terminated the following day, and if I don't have any back pay due anymore, what will happen to my remaining unpaid balance in SSS? Will the company hold my clearance unless it is paid or do I have to go to SSS for settlement?

What does it mean also when you say withheld taxes? What is the difference between withheld and excess tax? Thank you for the reply

If you have no balance in your final pay, you will have to settle your loan directly with SSS.

Withholding taxes.

For example ONLY.

Monthly Salary 12000
Tax withheld 1200

If total salary = 120,000
Tax withheld = 12,000

But after computing, your tax due from your total salary is only 10,000, then the excess (or 2,000) will be refunded to you, but the rest will be paid to BIR.

My basic salary is 15000 per month but because of incentives, my ytd gross as of this month is around 420k and ytd tax is around 60k. Will i get tax refund from this?

Based on that info alone, you will still owe 22k.

Based on YTD income of 420K and YTD Tax of 60K.
