Probationary Contract need advice

Nag tratrabaho po ako sa isang company
nag sign po ako ng probationary contract at matatapos this coming January.

Bago kasi gawing Probi saamin magkakaroon muna ng evaluation if ireregularize ba yong employment ko.

Balak ko na kasing aalis sa company bago ako maging regular dahil may valid reason rin ako.

Possible bang kung gusto nila akong gawing regular or makakapasa ako sa evaluation hindi ako pipirma or hindi ko tatanggapin yung offer para sa regular employment status ko.covered rin ba ako ng 13th month pay ko if hindi ako mag sisign ng contract? at eto pa pala
required ba talaga sa trabaho ko yung NC2 kasi hinihingi ng HR yung NC2 TESDA pero tinanggap naman ako sa trabaho kahit walang NC2.Ok lang ba na hindi ako kukuha?

yes you have option not to extend the contract. and unless supervisory yung position you are entitled to 13th month pay basta more than 1 month ka na sa company

thanks! more than one month na po ako mag 4months. pero medyo nalilito ako doon sa unang pag pasok ko. unang una 1month trainee ako may pinirmahan ako na contract as trainee. pagkatapos ng 1month ko binigyan naman ako ng letter for probationary contract. doon ako nalito. diba 6months lang ako maximum ng probi period? hindi ba kasama yung trainee period?

at required ba talaga ng batas natin yung NC2 sa mga technical fields? sabi kasi ng mga ka work mates ko required daw. doon ako nag-taka bat required what if kung ayaw ng employee na kumuha kasi unnecessarry na sakanya based sa kanyang experienced at crediblity.

yes pwede i extend ang probationary period if merong consent ang employee, ang premise is bagsak ka sana but bigyan ka pa ng chance to prove yourself with additional time if gusto mo ng additional time. if not part ways na kayo at the end of the contract..
so in short if ayaw mo na probationary ka parin pwedeng hindi mo ipagpatuloy.

nc2 can be required by the owner. hindi yan option ng employee kung gusto nya or ayaw nyang kumuha nito
