what move should i do?

im a legal wife for 10months now and currently pregnant for 5months. Pareho kaming seafarer and he's still on board currently. The wedding was just rushed and biglaan but valid naman po. Kakabalikan lang po kasi namin that time and he was very afraid na baka mawala ako ulit so nagpakasal na kami after 4years being together. Before we got married it happened i had an affair with my ex but it wasnt succesful and for 2years my husband kept on thinking about that, may nakapag sabi kasi sakanya then finally i admitted that affair, stil gusto nya ituloy ang kasal. for this past months lagi nya nalang binibring up yung topic na yun at wala pa rin syang peace kahit daw magkaka baby na kami. Kapag nagagalit sya lagi nyang sinasabi kaya nyang ifinance ang annulment though hinahayaan ko lang sya kasi alam ko its not that easy. We havent been communicating for 2weeks now and i have a feeling na parang gusto nya nalang kami mag part ways. Wala pa kami nasesettle for anything naman. Now these are my questions. 1. Papasok po bang abandonment kung hindi sya umuwi dito samin at sa mother nya sya umuwi. 2. As a seafarer meron po kasing poea law na 80% ng basic is dapat sa legal wife, can i still claim that kahit isa rin akong seafarer but as of the moment unemployed due to my pregnancy? 3. What else can i file against him?

you can always file a case for support or RA 9262 to compel him to support you and your child. That is a criminal case. Pwedi karin mag file nang abandonement if hindi na sya umuuwi under RA 9262 pa rin. Seek a lawyer.

Yes that's my decision talaga na kung hindi na namin masettle talaga at hindi sya umuwe mag file ng abandonement. It has been a month now na wala kaming maayos na communication dahil na rin sa pride and my feelings towards him is starting to change now. i want to ask lang po kung magdedemand kami ng financial support eh ilang percent po ba ng basic salary ang dapat ibigay samin? Does it change po ba kung may work naman ako?

depended yun sa need and capacity of the giver. You can ask 50% pwedi din 75% nang kanyang salary. Kahit may trabaho kay he is still required to support you and the child.

Ang court na po ba ang magdedecide kung ilang percent ang dapat ibigay samin mag ina? Sa poea kasi it says na ang allotment ng legal wife should be 80% ng basic salary ng seafarer, but im confused lang po kung 80% pa rin ang ibibigay samin kung isa rin akong seafarer. Maraming salamat po.

yes 80% parin that is regardless of your status whether you are employed or not. whether you are a seafarer yourself or not.

So eto po talaga ang rule ng poea for every legal wife? Depende nalang po siguro kung kung magcocompromise kami kung babaan ko ang demand?
