Mga ATTORNEY SIR, ask ko lang po kung anung ma-aadvice nyo sa amin

kami po ay working until now sa isang Kumpanya for over 6 years bilang graphic artist at operator ng nagcu-cut ng acrylic plastic at plasma machine, at router machine at large format printer exposed po kami sa radiation ng laser machine at amoy ng plastic, bakal at pintura. walang benefits o anu man wala din po kami C.B.A. ngayon po binabago ang sistema ng kumpanya, pag late may memo at pwede matangal. kaya lang po pinapirmahan kami ng memorandum ng late ang date ng mga late
halimbawa:

late ako ng may, pinapirmahan na sa akin ng august naka note dun na suspendido ako ng 15 days
late ako ng june, pinapirmahan din sa akin ng august naka note na 30 days suspension na ako.
tapos po etong september 17 may memo na binaba sa akin for termination na po ako pero late ko yun nung july pa po.
biometric po ang aming ginagamit bilang daily time record.

ngayon po mineeting po aki at sabing wala po kaming matatangap na bonus sa christmas dahil bibigyan daw po kami ng pagkakataon hanggang december kung late parin daw po tatangalin na po kami.

May mga tanong ako para clear tayo sa mga nangyayari sa company nyo:

1. 6 years na kayong nagtatrabaho dito na continuous? Or contractual ba ito na every 5 months nateterminate yung contract nyo tapos renewal na lang ang ginagwa? Kung continuous, dapat regular na kayo and dapat nakukuha nyo yung mga benefits na binibigay ng labor laws sa inyo. Kung regular na rin kayo, hindi rin kayo basta-basta matatanggal ng inyong employer since dapat justified yung cause ng inyong dismissal under the labor law.

2. So walang CBA nung kayo ay nagtatrabaho pa nung umpisa, pero ngayon under new management na ang inyong company and nagbabago sila ng patakaran, yun ba yung nangyayari? So meron na bang proposed CBA yung employer nyo para sa inyo? May employees' union ba kayo na pwedeng magrepresent sa inyo kapag magkakaroon ng CBA negotiations?

3. Walang benefits, meaning di ba nababayaran yung SSS, philhealth, and PAG-IBIG contributions nyo? Wala rin ba kayong mga Service Incentive Leaves or Maternity Leave (for women, of course) na binibigay ng batas sa inyo? Nabibigyan ba kayo ng payslips every bayaran para makita nyo kung paano yung breakdown ng inyong sahod from the HR or Payroll Department?

4. Nabigyan ba kayo ng employee's handbook? Paano yung proseso ng tardiness and disciplinary measures regarding latecomers? Please compare mo dun sa nangyayari sa inyo para makita nyo kung sinusundan ng inyong employer yung mga patakaran na ginawa nila para sa inyo.

5. Lumapit na ba kayo sa DOLE or at least sa Public Attorney's Office para humingi ng payo regarding sa sitwasyon nyo sa inyong employer? Kung sa tingin nyo ay nilalamangan kayo ng inyong employer, pwede kayong humingi ng tulong sa DOLE para malaman nyo rin kung ano ba ang dapat nyong gawin sa inyong sitwasyon. Yung PAO pwede rin magbigay ng libreng legal advice para sa inyong sitwasyon kung sila ay may kaalaman sa dapat nyong gawin.

tanong ko lang po. I was dismissed by my company right away for 3 NCNS (oct. 13,14 & 17). I then informed by Sup na magreresign and render 30days but my sup informed me that he recommended for my removal from our account. pagbalik ko ng 18, I was asked to sign 3 NTE's (first time ko pong magkaNTE since my 9months of work and within the 3 performance reviews I was rated with a 97-100% mark) and End of contract(btw, wala po kaming contract na nakuha from them just JO since the beginning kahit nung naregularized ako). As per HR po naprint na nila yung EOC ko, pero ako pa po nagtanong kung magkakaroon pa ba ako ng hearing prior to dismissal. ang sabi po sakin eh, right ko daw po yun. pero ilang ulit ko po sila tinetext to have it rescheduled kasi di ako pwede sa sinet nila na date- pero di nagrereply yung HR namin. 2x

question is: tama po ba na idismiss nila ako agad?

Dapat merong due process.

Bakit hindi ka pwede sa mga petsa na ni-set nila?

Ikaw dapat ang sumusunod sa sked nila, kundi baka isipin na pinapatagal mo lang ang kaso mo.
