good day atty.,

My husband of 3 years left me and our 2 year old toddler when i was 2 months pregnant. He doesn't give financial support to our son and my pregnancy, which is high risk bcos i immediately got pregnant after having a miscarriage due to a hydatidiform mole. He keeps on saying that he only left me and not our children, but he barely sees our child and even said he did not plan to get me pregnant. He's never given a single cent to us. He lives in our apartment, since he threw me out and me and my son moved back to my parents house. I tried to talk to him but he said his decision is final and he doen't love me anymore and only wants to see the kids. What cases can I file against him and how can I arrange visitation rights and financial support for my kids and our unborn child?

You can go to your local court, and file a case of Violence Against Women and Children. I strongly recommend this considering the statements you gave which I can only presume is mostly correct.

I want to be clear though that I am not a Lawyer, and my opinion is only that, and remains so.

You cannot file for VAWC as you have no grounds to. If your husband doesn't love you anymore, you cannot file a case based on this.

Just file a Petition for Support (for you and your kids).

may i add that in the 3 years that we've been married, i have caught him countless times having affairs with various women. i screenshot their messages and talked to those women. They have been saying that my husband claimed he was single while dating them. He has various profiles in several dating applications and i have caught him sexting or exchanging pornographic images to these various women.

The statement " I don't love you anymore" is considered emotionally abusive. And RA 9262 is exactly that: for emotional, physical, and economic abuse (lack of financial support).

I bet if this will stand in court. You cannot force anyone to love someone. There is this thing called free will. Any constraint on a person's free will is against his rights.

And yet you did nothing. I assume that you still slept or shared the same bed in those 3 years, did you?

If so, the law sees this as an act of forgiveness. Every time you sleep with your husband, considering his misdeeds, you are actually forgiving him when you stayed silent and did nothing.
