EARNEST MONEY RECEIVED BEING ASKED TO RETURNED BY BUYER OF HOUSE

I would like to seek advice regarding the problem that I got myself into. I applied for a housing loan from HDMF in April 2015. However, due to the separation from my husband and losing my job, I could no longer pay for the monthly amortization. I was able to pay only 10k in July 2015. This year, since my arrears are increasing, I thought of getting someone to assume the balance and pay for the arrears. An agent helped find a buyer and the agreed amount to pay me off is 140k and the down payment is 50k to which 37k was paid to HDMF. However, it was then that I knew the arrears is more then 37k and so i still have a balance of around 60k or around that amount. I didn't inform the Buyer the problem for I don't know what to tell them and so I no longer coordinated with them. They went to HDMF and found that the property was eventually foreclosed. I could not give any reason why I did what I did in not coordinating with them. Hence, my problem now. They now filed a complaint against me thru our Barangay. I tried my best to convince them to allow me to pay the 50k in installment since I was only able to get a job this April 2016 but they won't accept. They want me to ask my new employer to be my guarantor. However, my employer refused to be dragged in the problem. My company was supposed to give me a 50k loan to settle my problem provided that they will not be dragged down. However, the complainant insisted and so my company cancelled my loan application. I have no other means to pay the complainant but by installment scheme. I have provided a Promissory Note that I will pay them P7,500.00 a month until full settlement of the 50k but they refused. At present, they said they will file an estafa case against me and will ask NBI to arrest me immediately. Now, I would like to know if I will be immediately arrested by the NBI because if that is possible then I would have to make plans to transfer the care of my aged mother and 2 kids to a relative. I will remain in the house because I want them to see that I dont have plans not to pay my obligations. I would also like to know what steps I should take since they didnt accept my promissory note. Nagkaharap po ba kayo sa barangay nung ioffer nyo yung paraan na kaya nyo sa pagbayad? Kung makakakuha kayo ng kopya nung proceeding nung araw na yun sa barangay mas mainam, katunayan na hindi nyo sila tinatakbuhan. Good luck.

Opo, kaso ayaw po nila tanggapin na maghulog ng installment at gusto po nila nang orada. Sbi ko sge po bgyan po ako ng panahon. Tapos gusto nila idamay ang kumpanya ko para daw sigurado hindi ako tatakbo. Sabi ko hindi po ako tatakbo dahil ang mga anak ko ay naka enroll, may kontrata ako sa apartment na nirerentahan ko at malapit lng ang aking trabaho. Ayaw po nila maniwala at pinipilit na makausap ang employer ko. Ayaw po ng Boss ko dahil sa hindi naman sila kasama sa problema. At yung inoofer ko po na Promissory Note ay ayaw nila tanggapin. Ako po ay kanila na lamang sasampahan ng kaso at ipapadampot daw po sa NBI kse may kamag-anak po sila at yun daw po ang advice ng lawyer na tiyahin nila. Kase po yun lng kaya ko ibayad 7500 kada buwan sa loob ng 6.5 months. Medyo nang haharass na din po sila at pinicturan pa ang school ID ng anak ko para daw madali kami mahanap kung tatakasan ko sila. Maisasampa na po ba nila iyon sa korte/fiscal? Maglalabas na po kagad ng warrant of arrest? Anu pa po ang kailangan ko ihanda?

maam, normal lang naman ang matakot ka sa kalagayan mo, ito lang po ang masasabi ko base sa simpleng kaalaman ko at opinyon lang ito ha, hindi naman kasi ako lawyer or "bringer of light"
1. kung nagharap kayo sa barangay at hindi nagkasundo, ang lupon ng barangay ang gagawa ng endorsement sa MTC para sa kasunod na mga hakbang. Hindi ka basta pwede damputin ng NBI dahil kamag anak nila kamo.. illegal yun dahil hindi ka naman kriminal.
2. pumunta ka at humingi ng tulong sa PAO ng nakakasakop na korte sa inyo. Baka nga may mga naviolate na karapatan mo or violence na nagawa sa iyo.. like pagkuha ng picture ng ID ng mga anak mo or kung nandun yung mga bata nung hinaharass ka.

Thank you very much po. I plan nga po to go to PAO to seek help. Kase po yung Barangay captain po namin ay imbes maging mediator, nakiling pa sya dun sa complainant. Sya pa nag escort sa bahay at hinayaang picturan ang ID ng anak ko. Hindi man pinuwersa ang nanay ko sa paghingi ng ID para picturan, matanda na din po sya hindi nya alam na may mga karapatan din kami kahit respondent po ako. Atsaka nung lumapit po ako sa Barangay Captain ay tinaasan pa ako ng boses at sinabi magwiwitness pa siya para sa complainant. Salamat po at God bless po.
