ah sir/ma kc ganito po ngyari nkapgapdala na po cla ng earnest money sa acct nmin, ang ngyari po eh biglang ngbackout dhil po ang gusto nila ipadala muna nmin sakin nila ung deed of absolute sale w/ notarization.. di po kc pumayag ung papa ko na ganun ang gawin kaya po cla ngbackout.. ngkapiramahan nrin po s contract to sell... my karapatan po b silang mgback-out kung ngkapirmahan n s contract to sell?

I cannot say until mabasa ko yung nakalagay sa contract to sell. There are cases kasi na ang title ng document is contract to sell pero yun pala contract of conditional sale kung babasahin yung content ng contract. These two contracts have differences when it comes to legal effects. Meron ba slang representative dito sa Philippines na nakakausap ninyo in person?

ang problema po ung pera na ihuhulog ay manggagaling s bf nia na foreingner, tapos gusto nila hingiin ung deed of absolute sale nankanotarized pra daw maihulog nila ung remaining payments.

Sino ba nagprepare ng deed of absolute sale? Also, are you still in good terms with the buyer? If yes, you can execute a contract to sell or contract of conditional sale para protected ang rights ninyong dalawa (buyer and seller).

This is the solution that I would suggest under the circumstances.

But it is best for you to have a lawyer assist you in writing a new contract to make sure na tama yung pagkakagawa both in content and in form.

Ok, in that case, they just have to be assured na protected rights nila kasi nakasign naman kayo pare has sa contract to sell. I think kailangan lang na may magexplain sa manila kung bakit hindi pwede yung gusto nila mangyari na i-send mo na sa kanila yung deed of sale considering na hindi pa sila fully paid.

I think communication lang ang kailangan sa situation ninyo.

may communication kaming dalwa mam, pinaliwanag ko n rin s kanya, kso mukang ang walang trust eh ung bf nia kc sa bf nia na foreingner manggagaling ung pera.
Tpos ang sabi smin ganito nlng daw ang gawin nmin tutal nmn daw ntanggap n nmin ung earnest money, lakarin n daw nmin ung s BIR para mareceive n nmin ung CAR. pinapalakad samin lhat na hindi pa cla fully paid. Baka magtampo kami s bigas nian s gusto nilang mangyari..

nasaan ba iyong original copy ng contract to sell and deed of sale? very risky ang may CAR na galing sa BIR at bakit mo babayaran ang capital gains tax at documentary stamp tax na hindi pa fully paid. I think once the certification authorizing registration (CAR) of the property is issued by BIR, the buyer can use that to transfer the property to his/her name. Wala ka ng habol sa full payment mo. Besides, BIR requires a receipt of payment on the sale which is from you and you haven't receive the full payment yet. May agreement ba kayo duon sa earnest money with terms and conditions as to execution of the deed of sale upon full payment and surrendering the owner's duplicate copy of the title? Kung meron, hindi dapat nagawa at napirmahan ung deed of sale. The earnest money is an agreement on the sale and is forfeited by the seller should the buyer cancel the sale agreement at no fault of the seller.
