Arresto Menor

we have a for rent property and a person who is intrsted to rent on the said property gave 5ooo earnest money just 2 remove the for rent sign. its been a month that the person who gave the earnest money still dont want to give the down payment and sign the contract of lease. can we just return the money because we dont want the person to rent the property?
