I am a manager of a multinational company. Although I haven't signed any agreement regarding retirement age, I was informed by HR that I will be retiring next year at the age of 55. Previously, the company based the retirement age of managers from the Employees CBA at 55 years old. Recently, the employees' CBA and the company signed a new agreement to increase the retirement age of the employees. However, HR informed me that manager's retirement age will stay at 55 since this is not yet approved by the management.
Article 287 of the Labor Code says that in the absence of any CBA or any agreement, retirement age should be at least 60 years but not more than 65 years. Does this apply to managers who don't have any CBA with the company?
