first contract signed is 1 month, then after 1 month is 6 months contract, lumamapas na ang 6 months contract at wla ng kasunod pero tuloy pa din sa trabaho hanggang umabot ng 9-10 months. na promoted pa sa mas mataas na level pero wlang salary increase na nangyari. nag awol ang empleyado at di na nag submit ng resignation letter. may naiwang pondo na 21 days yung empleyado daw, saka yung last salary nya na umabot sa cut-off bago mag awol. at june na din nung mag awol sya so dapat may half sya ng 13th month.

posible pba na makuha nya yun?

its possible. Technically dapat i bigay ng buo ng company yun but its also possible na saibihin ng company na they will be charging damages kasi hindi nagfollow ng tamang procedure.

The employee should get clearance muna for any and all liabilities. If mabigyan sya ng clearance pwede na nya makuha lahat ng naiwan nya

perolampas na naman sa contract na pinirmhan nung employee yung time na nag awol na sya. fin contract sya suposedly on march. at june sya nag awol.. consider finish contract na yun diba? though wla nga lng exit clearance.

yes but if ang position mo is finish contract na then you can't ask for yung salary na naiwan

Ang sinasabi mo ba ay dapat hindi sya makakakuha ng sweldo sa buwan ng April, May at June dahil tapos na yung kontrata nya ng March at wala nang bagong kontratang ibinigay sa kanya?

Kung walang bagong kontrata kayong ibinigay sa empleyado pagkatapos ng kanyang kontrata at siya ay hinayaan niyong pumasok pa, siya ay maituturing na regular na empleyado (Regular by Default/Regular by Operation of Law). Pero hindi basehan ang pagiging Contractual, Proby o Regular ang empleyado pra makakuha ng sweldo o backpay. AWOL man o hindi, kung siya ay nagtrabaho sa mga araw na pinasukan niya, may karapatan siyang mabayaran.

was saying, if insist nya na end of contract na sya kaya hindi na sya obligated to pasok, then bakit nya hinihingi yung sweldo after ng expiration ng contract. cant have it both ways. if nagtrabaho pa sya after then technically hindi sya na endo
