Falsification

Hello. I badly needed your advice. I'm presently here in Japan. I used to be a brgy treasurer. After i resigned the council filed a case against me. Now a warrant has been ussued and im wanted for falsification and am not sure if it's plunder or estafa worth 250k. Is that still bailable? And is it alright if i go back to the Philippines now? I really wanted to fix this mess. I promised them that i will return the money but they still push through with the case. Our last fiscal hearing was dec 2014. I went here in Japan oct 2015. I waited so long for the arraignment but i never heard anything from them. Sbi nla hnd dw ako mtagpuan kaya d nai serve warrant. Hnd nmn ako umaalis ng probinsya namin. Pls help.. Thank you

Stay in Japan for 10 years as falsification has 10 years statue of limitation.

What about nmn po ung estafa case against me? What can i do about it?

Arrange mo na lang ng installment basis habang nasa Japan ka. Para di mabigat sa bulsa. irecord mo lahat ng binayad mo para di ka magoyo. Di ka naman nila mapauwi kung estafa case lang!

Is there anyway po na mwla ung warrant of arrest issued? Ganon nga po sna un plan e. Kaso ayw dw pumayag ng ibang members of council.

Kapag fully paid ka na sila na mismo mag asikaso ng pag cancel ng warrant. At least willing kang magbayad kahit installment kahit di pa pumayag ang ibang members ng council wala ka sa bansa.

So it means i cannot attend my son's graduation next year. Pero pwd po ba ko mg bail? Can i go back to the Philippines if i do that?

Kapag nahuli ka kahait makapag bail ka pa magkakaroon ka ng hold departure. So you are taking risk to go back.

Automatic po ba na my hold departure once a person has a warrant? Pano po kung kumausap ako ng abogado bago ko umuwi at byaran ung bail? Pwd po ba yun?

Kahit mag bail ka pa automatic na and hold departure mo halo na at alam nilang lumalabas ka ng bansa hindi ka na makakalabas muli!

i recommend you send someone to the court in the city or municipality where you were the treasurer and look up your case. you will be able to see whether bail will be allowed. But if you come back, you may need the permission of the court to travel out of the country again.
