Arresto Menor

It happened today that my cousin was driving along laong laan blumentritt when a tricycle without a headlight u turned at a fast speed and the car my cousin was driving crash into it. So in short 2 were dead and 1 in critical state.. According to the family members the driver was in a hurry because "may tutubusin dahil nacheckpoint at may marijuana sa bulsa." Then the family members said that the driver of the tricycle has no license... What charges will my cousin face? and is it his fault? What are the right actions to be done? Badly need your assistance on this one

Usual charges are imprudence resulting to homicide. But the important issues are: was there a traffic enforcer or police who apprehended them/responded to the incident? does your cousin have a valid driver's license? Basically, investigation will reveal who is at fault. Tell him to get a lawyer.Other unnecessary details only cloud the issue.

at this point, his best move is to cooperate with the authorities, but be careful of what he says. It's all up to the prosecutor now to decide whether he will charge him at the inquest which is possible. Prepare the requirements for bail just in case.

He has a license the other party doesnt because the driver of the tricycle is only 16.. Does anyone here know a lawyer near balintawak that can go and assist my cousin immediately?

as long as the police report states that, then the prosecutor will consider it. it may lead the prosecutor to refer the matter for further investigation and release your cousin, but considering the 2 deaths, I have my doubts.

Well things got more complicated cause the reason why the tricycle was driving really fast is because officers were chasing then due to possesion of illegal drugs...
