Change of Surname requires Cancellation of Entry and change of Name

Good day po. Gusto ko po sanang maayos na yung Birth cert ko since until now hndi pa din po surname ng papa ko yung nasa b.cert ko. The problem po kasi is my mother had 1st marriage. wayback 2012 po nilakad na namin to kaso hndi padin naayos, sabi okay na daw pwede ko na magamit ung surname ng father ko pero sa b.cert maiden name pa din po ng mother ko nakalagay. nagkaron lang po ng annotation po sa b.cert ko na nakalagay na ligitimate by subsequent marriage of parents. at may second page po siya na affidavit of acknowledgement. pero nung pumunta po ako sa NSO last week lng para ayusin, sinasabi po sakin na para madala ko na yung surname ng father ko need pong ng cancellation of entry and change of name na kung saan kukuha daw po ng attorney at sa court gagawin para matanngal daw po yung annotation sa b.cert ko na pinalagay nila dati. after po nun, pwedeng na daw process yung RA 9255. Sobrang dami pong requirements at time and money na kailangan. Pero this week nakapanuod po kami sa TV 5 na hndi na daw po required ng court and attorney para makapag change of surname. Badly need your advice po mga atty. Thank you so much

if that was atty mel sta maria, I wholly agree with him that it is no longer necessary if your father's name appears on birth certificate and there is an annotation that you are legitimated by reason of subsequent marriage

Thank you po. Any advice po and what is the best way po para maging maayos na po yung birth cert ko? Kasi po hndi po siya tinanggap sa CVEA nung pumunta ako sa NSO. Needed daw po muna ang requirements. Thanks a lot!

imo, you shouldn't have to do anything. it is the annotation that is proof that you can use your father's name.
