Hello,
I am currently waiting for my last pay. I resigned last April 2016. I have SSS Loan balance and I am planning to continue paying it with my new employer. I applied for a new job and currently waiting for my training to start.
I am worried if my previous employer will deduct the remaining balance from my last pay. It happened with my co-worker before. There's no agreement, I didn't signed any document that they will use my last pay to pay the remaining SSS loan balance. Can I insist to get the full amount of my last pay?

The SSS law and/or its policies regarding loans require the company to deduct the loan balance.

The employer shall deduct the total balance of the loan from any benefit/s due to the employee and shall remit the same in full to SSS, in case the member-borrower is separated voluntarily (e.g., retirement or resignation) or involuntarily (e.g., termination of employment or cessation of operations of the company).
