First of all, you need to clarify on why are they denying such claim of refund? let them put it in writing and also sign it so that you they cannot retract it in the future.

When was the letter of cancellation received, and when did you send your letter?

Compile all the letters that you received from the developer, and your letters that were stamped, "Received". Bring them to HLURB and ask for assistance.

Thank you so much for your advise.

I received the final Notice last week of January, 2016 (forgot the exact date), and I responded to them via email last feb 12, 2016.

We exchanged communications both call and email. Is this valid in legal aspect?

I have the same case w/ ravallejera, they have a no refund policy, until you request them to apply maceda law.

The problem I think is that they will supervised you when you have a lawyer supporting you.

In my case, they asked me a letter from my counsel requesting to apply the law in my account, and they will re-endorse it to the higher management for further comments and approval. Currently it's pending.
