i am married for 29 years to a an irresponsible man. I am still living with him but i made it clear to him that i dont love him anymore and we dont sleep together or have sex for several yrs now. I lost my love and affection bec even though he earned much more than my salary, i spend more in our house and he is just like my eldest son because he never take care of me. our house and my children.Even the small things like driving and fetching my kids he let me do it and even fixing our deteriorating house and the things all husbands should do to their kids and to her wife he never does. He is a weak man and a stingy irresponsible husband who is not sensitive to the needs of his family. I am not happy seeing him everyday and i want to have my own place and have my own life. how can i move out if he needs me because of the comfort he enjoys because i am here with him. I know he loves me but i hate his selfishness and we are incompatible in all things. I want to spend the remaining days of my life at peace. My kids know our situation and they also hate staying at home bec of their father's attitude and they worked in far place. How can i leave without any legal basis? I have a good job and i can support myself and i spend more in our house and sent my kids to school and he never did ask about money issues. He already knew this problem but he just give what he wants and if i will calculate my expenses and his in our household, mine is greater but he earns more, do i have to continuously ask? please tell if i have a chance and what grounds i will tell my husband for leaving him and i want him not to disturb me.thanks a lot.

Are any of the kids underage (=still having right to support) ? If so it has right to get support from BOTH parents, amont deoend of the capacity each have.

How about the house? Can you get part by marriage of the value or don't you bother?
If you get part, it can be
sold and split the money
or you or your husband can buy out the other.

You can get a LEGAL SEPARATION. Then you can't have other man, but you will have separate economy, so you will not he responcible if your husband mess up by for instance borrow money and don't pay back.

You can ask PAO (=Public Attorney Office) how to do it.

thanks for your reply lunkan and landowner 12. If i will file legal separation, on what grounds? can i also cite the violence against women? what is that article 19? of what law? if i cant remarry, can i have a bf? will i not be sued if i leave him and someday have a love interest? or be with a man? even without marriage? is filing legal separation long and costly before i get the verdict? meron ba chance na di maapprove ang legal separation? salamat po sa inyo mga replies

No you can't have boyfriend legal without an annulment. Rather many have anyway, but in the Philippines that's a crime so it's some risk. specialy if someone want to sabotage for you as for instance your husband.

I believe PAO offices assist with such cases as separations.

I hope you get better answers at the rest than I can give you Smile

(I BELIEVE no reason is needed to get legal separation, because it's NOT an annulment, it's separation of the economy. Just separate living places DON'T need any legal separation, but then your economies would be counted together still with the risks and problems such have.)

Tama.legal separation stillbinding ang marriage. U cant have a new relationship. Nor can marry.
