On what grounds should a wife file a case against her husband and the mistress??

the husband is workaholic and his mistress was his officemate. sometimes po inuuwi pa nya ung mistress nya para daw sa "work". his housewife knew that her husband was cheating on he but the husband didn't know that she know. she wants to sue her husband and the mistress.. on what grounds should she file a case? pwede rin po bang magfile din ang husband at mistress againts sa wife?? please...... i badly needed an answer po

The wife can file a criminal case for violation of RA9262 (Violation Against Women and their Children. she can use as a ground psychological abuse due to his husband's infidelity.

She can file a civil case for damages against the mistress for interfering with their marriage.

You can file a case for concubinage against your husband and his mistress. But this will not prosper if you consented to their cohabitation.

Notwithstanding that, you can file:

Violation of RA 9262 or violence against women against your husband.

You can file a case for damages under Art. 19, 20, 21 against the mistress.

ask ko lang po kung ano pede ko i file na case sa husband ko at sa mistress nia.
legal wife po ako, may 1 kaming anak, 2 months old pa lang po ung anak namin nung iniwan kami gawa sa mistress, now i heard that magkakaanak na cla.

their child has the legal right to bear his father's surname if they so allow.

if they are living together, you can file a case of concubinage against them. you can also file a case of ra 9262 against your husband. against the mistress you can seek monetary damages for her interference against your marital affairs.
