Are missing husband grounds for dissolution of marriage??

Dear Sir/Madam

Good po sainyo. I just want to seek an advice about my concern. I was separated with my husband almost 10 years now. Meron po kaming isang anak na ngayon ay 17 years old na. No child support, no communication at all, the last time I heard was meron po syang ibang babae and thats the reason na nakipaghiwalay ako sa kanya. And besides po he's involve in NPA and the reason why he left our town is isa po sya sa mga itinuturong kasangkot sa paglusob sa munisipyo ng aming lugar at ngayon po ay wanted sya sa bayan namin.

Ang tanong ko po ay ito.. ako po ay nasa ibang bansa ngayon at meron pong kinakasama na isang american citizen gusto nya po akong pakasalan at dalhin sa america hinde po ako makapag file ng annulment kasi wala po akong balita sa dati kong asawa (kasal po kami ng 1996 at meron record sa NSO) kaya po me nakapag sabi sa akin na pwede daw pong grounds ang missing person. O nagtatago po sa batas. Sana po ay mabigyan nyo po ako ng payo sa lalong madaling panahon.. ano po ang mga dapat kong gawin at gaano po katagal ang proseso nito.

Mag Pa open ka ng case na missing person! Sigurado namang hindi lilitaw yun dahil nagtatago nga eh! Kuha ka ng lawyer pagka apply mo para maidokumento ang pag report mo! After certain time na hindi sya sumipot pwede nang presume dead ang situation mo so pwede ka na pasakal ulit!  geek

@ AWV- thanks for the reply... Is it possible po kaya kng my Mom ang mag rereport na missing ang manugang nya? D po ba sya ma question kng bakit 10 years bago ako naghanap.. And besides po alam sa munisipyo namin ang kaso nya... And I'm sure na alam nilang nagtatago ito.. Pwede po ba akong magfile ng case as missing person sa ibang municipality na minsan sya ay tumira gaya po ng tondo.. ? And aside po sa missing person ano pa ang pwedeng gawin na hakbang para sa pagpapawalang visa ng kasal namin. Salamat po ulit.

He is not a missing person, he is a wanted man. You cannot report a missing person. Furthermore, if you are planning to get your annulment using that ground and later on apply for US Visa, i doubt it will work. US immigration/embassy are no aware of that "style" and there is a strong possibility that they will do some investigate. They will not issue your VISA if they find your husband is still alive. My suggestion is find a lawyer expert in this kind of situation and knows the US immigration procedure.

@concepab she has been in US for 10 years. In UK, US, Australia, New Zealand etc. they only requires 10 years back records of their whereabouts. Even if she didn't declare her marriage to him they will not dig any further kahit mag require pa sila ng cenomar, or she declares her marriage to him and file that her previous was missing for many years then she filed a missing person claims. If no one can tell where he is physically not just hearsay and know his whereabouts (because he is wanted he is not likely to claim his marriage to her or expose himself to public) then she appeal for missing person and it's been recorded after several years she will be allowed to marry, as if no sign of her previous husband the presume dead will be filed on her appeal. Her case is easier kasi nagtatago ang asawa kaya more likely na magawan ng paraan ma record and presume dead! Very Happy in other words it's better for her to declare it than deny it!

Ah ok. Well, wala naman siyang sinabi ganyang info previously. hehehe but still, check with immigration expert and lawyer. mainam na yung sigurado.

Thank you po sa pag reply nyo sa post ko. I've been outside the country (philippines) for 10 years.. 6 years in Bahrain and nag cross country po ako dito sa Greece and I'm 4 years na dito so all in all is 10 years. Emotionally devastated po ako ng nalaman ko na bukod sa kasapi sya ng isang grupo na against sa government nalaman ko pa na me ibang babae sya. Kasi nakausap ko mismo ung babae sa phone. Kaya sa loob ng 10 taon hinde ako umuwe sa Pilipinas. Yung anak po namin ay pinakuha ko sa mother ko (8 yrs, old sya noon) at mula noon wala na akong balita sa kanya. Meron po akong lawyer na kinunsulta dito to ask kng ano ang pwede kong gawin... ang unang tanong po sa akin "bakit ngayon ka lng nag decide mag apply ng dissolution of marriage after 10 years"? Honestly sabi ko wala na akong planong mag asawa bukod pa sa napakamahal ng gastos mag pa annul. But now things changes and my mind change too.

I already tell my Mom to make an appointment to a lawyer I hope all my querries will be solve and start the procedure as soon as possible. Thanks for making time to share your ideas to me. God bless...

Good luck po. Oh, and one more thing; if you will use "presumptive of death" for annulment and let us say ma-grant ang petition mo, then biglan lumitaw ang first hubby, your marriage with your second hubby will be void... yung ang pagka-kaintindi ko sa previous post na nabasa ko dito. I hope a lawyer will tell kung mali ang pagkaka-unawa ko.
