1st, we don't call it back pay, we call it final pay.

2nd, final pay consist of prorated 13th month pay and the pay that you have not received during the last cut-off.

3rd you can get everything after you filed clearance after your last contract.

Good day po,
I just want to ask, if natapos po ng employee and whole year before sya nag resigned wala na po ba syang makukuhang returned withheld tax?

it depends on the how good the payroll system and / or the payroll master is.

If your company is using a payroll software, they are usually accurate. but in case they are not, it will depend on the payroll master, who usually starts computing the annual tax at the start of October to project how much tax to deduct from your salary for the remaining months.
