hiwalay po ako sa asawa pero dipa po legal

mag5 years napo akong hiwalay sa asawa ko, pero kahit magkano wala naman siyang sustento sa dalawa kong anak. ano po kayang magandang gawin kasi po sa sss ko siya dependent ko at mga anak ko pinapaalis ko po sana pero need padaw po ng legal docs. eh wala papo akong pera para sa annulment. ano po kaya magandang gawin?

Annulment lang po talaga ang solusyon dyan kung gusto mo talagang habol ang asawa sa yo. Pwede ka naman pumunta sa PAO. Libre lang naman dun.

sa annulment, wala talagang mabilis unless yong pagpapawalang bisa ng kasal niyo ang based lang sa mga documents like marriage license or birth certificate.

Pwede din try mo ipahiwalay niyo na lang ang property niyo, Judicial Separation of Property... In that way, kasal kayo pero wala siyang habol sa anumang income or benefit na makukuha. Ang kadalasang reason dyan ay hiwalay na kayo for more than 1 year. Pero thing is, kapag may masamang nangyari sa iyo, legal heir mo pa rin siya.

Ipa-file mo yan sa korte. Di naman kailangang pumayag siya dapat lang may rason ka sa pagpapaseparate ng property nyo.

Kung di kayo mag-aagre, pwede na ang korte ang magsi-separate at ang mga grounds ay ito:
“(1) That the spouse of the petitioner has been sentenced to a penalty which carries with it civil interdiction;
“(2) That the spouse of the petitioner has been judicially declared an absentee;
“(3) That loss of parental authority of the spouse of petitioner has been decreed by the court;
“(4) That the spouse of the petitioner has abandoned the latter or failed to comply with his or her obligations to the family as provided for in Article 101;
“(5) That the spouse granted the power of administration in the marriage settlements has abused that power; and
“(6) That at the time of the petition, the spouses have been separated in fact for at least one year and reconciliation is highly improbable.

hindi po required ang participation ng asawa sa annulment. in fact, bawal po ang sabwatan ng magasawa sa annulment. ground po ito for dismissal.

How about po kung gusto mong mag claim ng share sa conjugal properties ninyong mag asawa, judicial separation pa rin po ba?

Legal separation lang pwede n if just properties ang cicern. Less expense. Pero can not remarry
