Hi I badly need help regarding with barangay business permit.

I have a small computer shop, which started 2012, this was the first business I have established from the little savings I have kept.

So, first, I was issued a barangay business permit for the first year we have operated, so everything was smooth and all at first, at the same year, I have tried to obtain the City Halls Business Permit.. but due to circumstances, like when I got there, the government suddenly declared a suspension of work due, to this incoming storm that will hit the metro.. *isnt that great?, in short, I have to postpone it some other time.. and then I tried again after several months.. because of my graveyard shift at work.. I postponded my sleep just to get this thing get over with, but then when I was in the city hall.. BPLO, around lunch time.. waiting for my turn to be served, but then a fire suddenly started inside the office, because of an unattended electric stove.. again everything was halted.. and was advised to come back again another day.. so I was WTF!! Im sleepy as hell.. so I just went home and slept..

So the problem now starts here, for the first year, the business was slow for the past 3-5 months.. which is okay for a business who just started.. and then after 8-12 months of operation.. we have been steadily gaining popularity among the residents there.. even from other barangay.. mostly kids.. and several business establishments.. because compared to others, our services were way better. and improve them per customer requests.. from printing, computer services, odd jobs requested etc etc.. we take all of them.. as long as we know we dont break any laws..

In our area, we have 4 or 5 other computer shops, and slowly as we gain popularity, the other shops closed their business, which we did not intended to do, so as of now.. out of 5 shops near us.. around 10-15meters or more ...apart.. only 1 is left, thus making our selves vulnerable to the eye of "ingeteros" or watchful eyes of the community..

So for the first time, in the same year, 2012, I was called upon by the barangay offcials, to control our customers, from noise and public urination... we have complied to their requests.. cleaning my surroundings etc.. posted infos on the wall of the business, and talked with customers regarding their behaviour.. that we should use the proper facility in regards to urination .. I started a campaign inside our business.. so that everyone is informed.. so as I know, I have done my part with regards to educating the residents with the barangays concerns.. so thats that..

But every now and then, even before the other shops closed their business, we have been cherry picked by the barangay for causing mischief and distrubances in our area, noisy kids..public urination.. jumping over the fence of barangay when they close the gates of the streets.. which is from our point of view.. not all noisy kids are from us, I know there are some.. but not all.. but I control them.. public urination.. is a nations problem.. again I know some kids.. even if you tell them not to... they still go.. especially when they too live on the same barangay.. and sons of kagawads or tanods.. even the pedicab drivers too.. which I can't control.. but whenever those thing happen.. its on me, which is unfair..

Plus, they are insisting that I let students use the shop during school hours, which is not.. well except for educational purposes like printing and a quick research.. and also, when their YAYA/guardians, leave the kids at our care.. which most of the moms, do.. so they can take care of their business for an hour or two..

To cut the story shorter, those are the main reasons why I am having problems with the barangay permit getting declined.. we are tying to find out means of obtaining this permit.. but due to our bad reputation, the kagawads who are supposed to be not biased are controlling everything.. they simply declined because maybe, just a maybe, one of the kagawads is the owner of the other establishment that recently closed in our area.. plus he is in good terms with our competitor.. which is just okay.. if they play the same game fair and square.. same business.. but we are the only once getting declined..

Also, they simply put all the responsibility regarding enforcing the barangay rules.. public urination, its not even on our side of the road, jumping over the fence of the closed gate of the road.. which we do not have any authority to do so, we can inform.. but we cant enforce.. since I too am just a resident of the community.. if they want to enforce this.. they should have put sentry there..

I am waiting for the barangay to reply with our request to talk with the chairman.. But I just dropped by to gather some comments and suggestions on how to handle this issue..

Can they not issue this permit with these kind of problems?? can they close my business with these reasons??

I really need some advice. As far as we know, we have done everything within our means to address their concerns.. but as they say.. they only see the evil.. not the good..

This is a REDICULOUS law the Philippines have, which make a business can be forced to CLOSE, because of being TO GOOD !!! (=being hard for competitors) by competitors being buddy with handler - or by bribe... Evil or Very Mad

In my home country business permits are FOR EVER (except for businesses with big danger risk, which need inspections and renewal of permits). Other businesses just need to not make any SERIOUS law break (for instance failing to pay MUCH tax). I started a business when I were in High School many years ago and the permit is valid STILL...

Where are you from?

See even foreigners, find it stupid. Its really perplexing, how this local government officials remains in their position.

One more thing, I jsut received a letter from our barangay, their answers for denying our permit.

1) we did not submit the permits last year? which I find.. why should we? its not even a requirement to acquire one..

2) we should be 10 meters away from the church.. uh? when did you see a mountain move? how can I move a building??

3) sanitation or public urination.. its not our problem..

4) continous disrespect towards barangay officials.. they did not stated how.. but from what I have heard from the neighbors rumors.. its because we never greeted this official.. whenever he passes by.. which is the most childish and most ignorant way of putting disrespect in concept..

Later I will try to reach an agreement with the chairman.. see if he even knew what was going on..

I'm from Sweden, but is crazy enough to plan to move to the Philippines and start a business there Laughing
That's why I'm studying parts of the Philippine law.

Yes, I find that yearly LOCAL demanded permit very remarkable.
(In my home country the permit is valid for ever in the WHOLE COUNTRY. We just need to inform the business register when we change adress.)

But I have found some GOOD Philippine business laws too e g BMBE.

Do you mean you didn't get a permit BEFORE you started the business?

Actually its fairly lax here when it comes to law.. they give you freedom for almost all what you do, except for causing civil disturbance and all.. basically they dont care... make yourself comfortable... until you make a mess for yourself.. you know what I mean..

Yes.. I did have business permits before.. Smile But as to whether they require it... its clearly stated that we just need the DTI for new business.. or the previous permit to acquire/renew one... but now they are denying me to get one. So I cant renew/apply for new business.. which is so *&(#* up!! knowing their "resolutions" that they impose on me..

Im not a lawyer/dictionary or anything but when you say "resolutions" its just a mere statement.. an expression of sentiments or opinion...  if I get my english right?

We have not defied any rule of law.. but still denied of our rights:)

Actually the ones that are denying me is the local government unit..  the ones you need to get a municipal permit.. or city hall permit so you can operate.. we have those even the receipts.. the ones who are running that office in our area are retards.. they feel they can maneuver businesses/persons with their current position which is stupid..

Thinking that all the people who engage with them are stupid.. which is very annoying at times.. cause normally we don't make things complicated.. we just say yes.. to not more engage in all of the moronity.. but with these power tripping idiots make everything like calculus Smile

We really should have the government elevate the standards of electing public officials..

May I now warn you, that some of the officials here in the PH are not even HighSchool graduate.. especially remote areas.. so you better learn to understand the thinking of the stupid person.. Smile

Well. I don't know what's true, but I have heared of people even put in jail for FALSE aquisations, one American was even found guilty to murdered someone HIMSELF in the Philippines, although he could PROVE he wasn't even in the country then!!!
And a lot of foreigners have been murdered. Even when a stabbing to death was in VIDEO, the judge found the
- rich - Filipino murderers only done a SMALL crime!

And as you have noticed yourself - an opponent can stop the business permit to be extended...

There are many stupid officials in Sweden too. Once I asked them if it's a requirement to have a pea sized brain to get their work. They didn't like that Laughing
But here it's a huge difference, here is almost no corruption. (The politicians sneak get some dinners and give themselves - official - to high SSS, but beside such it's almost nothing. One minister had to leave just because he hadn't pay TV fee, and a top politician was kicked out just because she used the parlament credit card when she bought a chockolate bar... Laughing

Well. High exam is NOT a guarantee against stupidity Smile in Sweden either.
Actualy two of the MOST clever Filipinos I know don't even have High School exam.

It's some funny "western" countries are counted as much richer than the Philippines, but many have maids in the Philppines, but in "western" countries very few can afford that Smile

Thats what you need to prepare for.. really amazing our system works here..

So its important to know your right here.. because those who know can easily wiggle your way out.. and ofcourse money.. its really sad when you think about it.. cause the government protects more of the oppressor than the oppressed.. they delay everything with law.. its a rare sight.. that the weak wins against the strong.. so you need to prepare your heart and mind in such cases..

But then again.. knowledge without resource.. is a formula for failing too.. so you better have your resource saved up..

Its really sad.. when all goes by the law.. but the people who are in position gets the work around or even changing the law when they need too.. to take an advantage.. sucks..

Hopefully, new leaders could address this, PH government is growing backwards.. not forward..

Yes. Laws are suppoused to protect the WEAK...
This problem is mainly the Spainards fault, because during the colonization they made laws to protect the SMALL group in POWER against the many poor common people - but the Filipino politicians have KEPT these type of laws long time now... Evil or Very Mad

well its like that in the PH.. if you will always get out of the bind if you have deep financial resource.. or.. you are from one of those "special" clans..

or pick a place with normal people.. they are easy to get along with Smile I'm sure you you can adapt easily here.. except for the hot weather.. communication? hmm.. almost all can understand english.. and talk a little.. so its easy to get around Very Happy

To give you an objective assessment and comparative reference, ask other nearby Barangays with computer shops their treatment of computer shops.
It helps to know municipal/City ordinances and local barangay guidelines requiring compliance and corresponding sanctions in case of violation.

Just some added thoughts.
