sleeepy

Arresto Menor

Hello,

I have a boyfriend who I met online and we've been official since september last year but we havent met in person yet. I have always liked to explore my sexuality (masturbated with toys) but I have never been one to just sleep with random people. I really do love my boyfriend and we've decided to have skype sex and it is in fact consensual. He does not pay me for it, I just really like getting off with him.

I live in an apartment and I got hospitalized earlier this january for a whole week. When I finally went back to my apartment I saw that my stuff were touched by someone. Turns out the owner of my apartment was told by some of my neighbors that I have skype sex. The owner took pictures of my toys and said that he will sue me for cybersex.

Now I have read online about our law for cybersex. It is defined as "The willful engagement, maintenance, control, or operation, directly or indirectly, of any lascivious exhibition of sexual organs or sexual activity, with the aid of a computer system, for favor or consideration."

I am just wondering if what I did is considered cybersex because I do not do it with my boyfriend for favor or consideration. We are not in a contract and he does not give me anything in exchange for it.

I hope someone can help me about this.
Thank you

Prision Correccional

There was no violation of the the cybercrime law. If that is the only instance that happened. Meaning, you havent done it with other people, because the NBI can trace your activities. As for the apartment owners action, there was a violation of your privacy since, he entered into your room without your permission and without any order from competent court.

If your having cybersex with your online bf, why tell anyone, especially neighbors ?

This must have happened because the owner heard it. Obviously he did not guess

If notice of entry was not given and it is stated in your contract that the owner must give notice and at reasonable time, I would think you can maybe file against him for unlawful entry and/or invasion of privacy
