Hi, I have recently separated with my live-in partner. Not long after a post came out on FB about him, the third party, me and a picture of our son. Apparently he is claiming that the account was made by me because the email used was similar to an old email account that I had. Insisting that the account was made by me, when I was at the office he entered my home and installed a keylogger on my computer. The day after I got a notification on my cellphone that someone had accessed my FB account. I was able to retrieve my account back but I want him to pay for what he has done. What case should I file against this person. Any assistance will help. Please.

Go to the nearest NBI Cybercrime division and ask help in filing a case against him for violation of the Anti-Cybercrime act of 2013, specifically the provision on illegal access and/or illegal interception of data via the usage of an unauthorized third-party keylogger application.

Un ex po ng partner ko eh pinost sa wall nya sa fb ang picture ko including my real name..and sinasabing bitter daw ako at ginugulo ko siya. Ipinahiya po ako at pinagtatawanan ng mga nagcomment sa post nya. pede po ba ako magfile ng kaso? Yung nagpost po is currently nasa Riyahd as DH po.

Well, you can file a case, but the person is still in Riyadh and our courts do not have jurisdiction over another country.

I am not sure if that person can be deported over the possible case you can file against her (online libel, a criminal case).

Your only chance for the courts to get jurisdiction over her is kapag umuwi sya and doon pa lang sya mabibigyan ng arrest warrant if the prosecutor of your case finds probable cause sa pagsampa ng kaso against sa kanya. Take note that you have to take screenshots of her posts, and you have to have those verified with the NBI Cybercrime Division.

Paano kung ang krimen ay ginawa sa "internet"?

Noong July 25, 2011 ay pinasa ng Kongreso ang “Cybercrime Prevention Act of 2012″ kung saan ang "Libel" ay isinama bilang isang uri ng "Cybercrime" kung ang libelous comment or post ay ginawa sa Internet. Ang penalty ay imprisonment for a minimum period of four years and one day to a maximum of eight years, per offense. Ito ang tinatawag na online libel na katulad ng libel sa Article 353 na ginawa sa pamamagitan ng isang computer.

Ayon sa Revised Penal Code, Article 353 ang Libel ay isang isinapubliko at malisyosong pagbibintang ng isang krimen, bisyo o depekto o isang aksiyon o hindi pag-aksiyon ng isang tao, kundisyon, status o circumstances kung saan ito ay nadishonor, pagkapahiya at paghamak ng isang tao o korporasyon. Ang libel ay pwedeng macommitt by means of writing, printing, lithography, engraving, radio, phonograph, painting, theatrical exhibition, cinematographic exhibition, or any similar means, shall be punished by prision correccional in its minimum and medium periods or a fine ranging from 200 to 6,000 pesos, or both, in addition to the civil action which may be brought by the offended party.

Saang korte mo dapat isasampa o ang venue ng "cyberlibel"?

Ayon sa isa sa mga naunang kaso ng "internet libel" na nakaabot sa Supreme Court [Bonifacio vs. RTC of Makati, G.R. No. 184800, 5 May 2010], ang venue o ang korte na dapat pagsampahan ng cyberlibel ay pwedeng mamili sa (1) actual residence ng offended party sa oras ng paggawa ng krimen; or (2) kung saan unang pinalabas at napublish ang libelous article.

"It becomes clear that the venue of libel cases where the complainant is a private individual is limited to only either of two places, namely: 1) where the complainant actually resides at the time of the commission of the offense; or 2) where the alleged defamatory article was printed and first published.

Kung ang offended party ay isang residente ng Pilipinas at dito niya nakita ang napublished na cyberlibel sa Facebook, pwede niya isampa ang kasong kriminal sa Pilipinas kahit ang gumawa nito ay nasa ibang bansa.

Unfortunately, where was the person nung napublish sa Facebook yung mga libelous posts na yun? Di ba sa Riyadh?

Since dun yung actual residence ng gumawa ng krimen na online libel, walang jurisdiction ang ating mga korte since sa Riyadh nangyari ang krimen.

Saan ba napublish yung defamatory article? Online, sa Facebook. Sa Riyadh, since dun nakatira ngayon yung person na nagpublish ng defamatory article.

Since both factors point out to foreign publication, mahihirapan kang makakuha ng jurisdiction over dun sa person na nagpublish ng libelous remarks, UNLESS ikaw mismo pupunta sa Riyadh para magsampa ng kaso against dun sa taong iyon sa mga korte doon.

Para mas makakuha ka ng authoritative na sagot, mas mabuting kumausap ka sa isang lawyer na criminal law ang specialty para masiyasat nya kung may kaso ka nga bang pwedeng isampa dun sa kabilang panig.

magandang araw po tatanung Ko lng po kung anung dpat gawin ng aking asawa...ang problema Po ay nagsimula ng magtayo ng business ang asawa ko at pinsan nyang babae....ngayon po syempre share po cla ng asawa ko...tpos naluge po ung negosyo at ibinenta nla ang mga gamit para mabyaran ung renta ng pwesto pero walang natira sa pinagbentahan...ngayon po binabawi ng pinsan nya ung pera na naeshare nya ngunit wlang maibigay ang asawa ko dhl wla naman ponp natira sa pinagbetahan binayad sa renta at mga inutang na gamit...
lumipas ang ilang bwan nagpost ung asawa ng pinsan ng asawa ko sa facebook at nakatag po sa maraming tao...at nasundan pa po ulet nitong august 6, 2018 maliban pa po dun ay may mensahe pa ng pagbabanta sa buhay ng asawa ko...anu po ang pweding gawin ng asawa ko...

Di naman guaranteed 100% success ang mga business. There are times it is bound to fail. Your cousin invested money sa business nyo, and di nyo naman kagustuhan na malugi ito. Your spouse cannot realistically shoulder all the losses of the business, so walang basis yung pagpost nya sa social media against your spouse.

Online Libel ang pwedeng kaso na i-file sa kanya sa korte.
