I NEED YOUR LEGAL ADVICE PLEASE.
Last December 6 2015 nagalit sa akin foreign employer ko sinigawan nia ako at kinakalampag nia ang mga upuan at mga pintuan ng refrigerators sa kusina na minamanage kong accommodation. Furious sya that time. Takot na takot ako kaya on that day nagresign ako effective that day dala ng takot at emotion. PERO kinabukasan DECEMBER 7 2015 ay agad kong niretract ang resignation ko dahil narealize ko na hindi tlga resignation ang decision ko at nadala lang ng takot emotion kaya niretract ko agad kinabukasan. Pero pinauwi pa rin ako ng employer dahil nagresign na daw ako. Di nila binigay ang 1 month salary deposit ko sa employer pati huling sweldo ko at pinabayaran pa sa akin lahat ng recruitment expenses nila. HINDI KO PO TLGA INTENTION NA MAGRESIGN. NADALA LANG AKO NG TAKOT AT EMOTION. PERO KINABUKASAN NIRETRACT KO AGAD UN RESIGNATION KO NA NIREJECT NG EMPLOYER.
MAY MAHAHABOL PA PO BA AKO SA EMPLOYER OR AGENCY AT SA INSURANCE COMPANY INSURED PO KASI CONTRACT KO? ILLEGAL DISMISSAL PO BA GINAWA SA AKIN KASI NAGRETRACT NAMAN AGAD AKO KINABUKASAN?
Ang dami ko pong mga naiwang bayarin dito sa pinas. Tulungan nio po ako legal advice po.

Nag resign ka at in effect tinanggap na rin nila.

Kung magre-retract ka, magiging effective lang yan kung papayag o tatanggapin ng employer.

Kung hindi, wala ka nang magagawa.

Nabasa ko po sa isang legal website. Kinikilala po ba yan ng Philippine Labor Law? "If the resignation was in the heat of the moment and there are special circumstances, the employer should allow a cooling-off period to ascertain if any other matters arise to cast doubt on whether the employee really meant to resign. A reasonable cooling-off period may only be a day or two, but this will depend upon the facts of the individual case. If the employer fails to allow a cooling-off period and immediately accepts the resignation, then a tribunal may conclude that the employee had not in fact resigned, but was dismissed by the employer."
