Hello,

I am a call center employee who did not get regularized and was given the option by my boss to just resign and extend my employment for another 30 days instead of being non-regularized.

I grabbed the option to resign as the extra month of work will help me in supporting my family while looking for job opportunities elsewhere. My last day at work based on the resignation letter i submitted is on April 22, 2013.

I tried retracting my resignation because i was advised that there are loopholes in my contract that could be used against the company. Plus, no performance reviews were done prior to my boss breaking that news that I will not be regularized - performance reviews that should have been conducted on a monthly basis as stipulated in my contract.

My boss told me that it is her discretion whether to accept my retraction or not.

Question is - is this really the case? Could my boss really opt to refuse my retraction so i could not take legal action against the company?

Yes, decision ng management kung anu ang effective data ng last day mo, kung approve ang resignation mo na sinubmit(at dapat me pirma yan sa mismong hard copy ng letter mo) at OO, sila rin magdedecide kung mareretract mo ang resignation mo. Mahihirapan ka maprove na forced resignation itu or illegal dismissal kasi ikaw me intention na rin na magresign. Kung probationary ka, tama ka na dapat nabigyan ka ng companies ng evaluation before your 5th month. This way, alam mo ang standing mo kung mareregular ka or not. Sana you took the 1 month na extension pa, nagpa-6 months ka na sa company kasi by law, REGULAR ka na nun. Me papel man or wala.

Kung me evidences ka na nagsasabi na pinagreresignka nya then mapuprove mo ang forced resignation at illegal dismissal.

Actually, lumagpas na ko ng 6 months sa company kasi pinag-render pa ako ng 30-day notice.

Does that actually change things or ibabalik lang ng boss ko yung fact na nag-resign ako?

Kung ganun po, regular employee ka nung nagtake effect resignation mo. MAtanung ko lang, me kopya ka ba at ang HR ng resignation letter mo na me pirma ng manager mo? at me date na ng approved last day? Kung meron nang pirma ng manager mo, then official na yun. Mahihirapan ka na ipush na maretract pa resignation mo.

Ang pwede mo pagtuunan ng pansin is yung forced resignation sayo. Kung me evidences ka na kaya ka binigyan ng resignation option ng boss mo ay kasi mareregular ka, mas okay. Kung me ebidensya ka na sya mismo ang nagpaparesign sau like email or me witness ka then majujustify mo na ang iyung illegal dismissal ude to forced resignation. Tandaan mo ang resignation ay dapat voluntary, meaning, wala labag sa loob mo ang paghahain nito base sa personal na dahilan mo.

Me separation pay ka na ng 1 month kasi considered ang 6 months na tenure ng batas na 1 year na. Yan e kung mananalo ka sa complaint mo sa NLRC.

Btw, di po ako lawyer ha. Ako lang po ay 10 yrs na sa IT industry at more than 8 yrs na nagmanage at nagsupervise ng tao. At me mga naging labor cases na rin ako, so better share share na lang ang knowledge baka makatulong sa iba. Smile

actually, what my boss and employee relations are insisting is that i voluntarily resigned but i beg to disagree. my boss did not ask me bluntly if i wanted to resign instead of being non-regularized but she did imply that resignation was an option

here is an excerpt from her email:

"As discussed, instead of non-confirmation, we will proceed with your letter of intent to resign."

Here's a follow-up email after a couple of days kasi hindi pa ko nagsubmit ng resignation letter:

As discussed, please provide the dates also your resignation letter so we can start processing.
