Good Day,

Im a regular employee for almost 6 years in a reputable company and included in top 50 corporations in the world. I filed my resigned last dec 18 2015 and stated/ follow the rules of the 30 days turnover thus will effect on january 18, 2016. However, my employer decided to make it effective Dec 31, 2015 or less than 30 days. My questions are and speculations as follows;

1. Is this legal?
2. Cut off or reset of our benefits is every January of the year. (Medical, SL and VL, etc), Since they moved it to December 31, my benefits for 2016 will not be part of my last pay.
3. Can i still demand until January 2016 effectivity?

Thank you in advance. Hope I can find answers here.

1. Yes
2. Do you get your full benefits (medical, SL, VL) at the start of the year right away?
3. Demand? No. Ask? Yes. No guarantee of approval.

HI Sir, thank you for your time. answer on #2 yes. VL, SL and Medical resets every 1st day of the year. Another question is, if they shortened the 1 month notice will i still get paid on the remaining period of notice?

Benefits reset at the start of the year - but does that mean that you can use it all right away?

Can you file and use your full number of VLs starting January 2?

Generally that's pro-rated.

As to payment for the remaining notice period - generally no, unless the company says they will.
