Arresto Menor

If a Lessor agrees to have his apartment occupied immediately by a prospective tenant wherein the lessee paid only the 2 months deposit but promised to pay the 1 month advance on a specific date and also to sign the contract on the said date and did not comply with the latter agreement( that is no advance payment or contract signing occurred } Will the lessee be considered a tenant even if has stayed for over a month? If not, what can the lessor do to evict him/her? Also take not that the reason why the lessor does not want continue with the contract is because the lessee had made several promises to pay but did not materialize> Thank You

the occupant is considered a lessee on a month to month basis. you have a right to eject them at the end of the month by initiating an ejectment complaint at the bgy.
