Good Day Sir,

Question lang po regarding after ng case. We were terminated illegally and nanalo nman po kami sa kaso. We were entitled for a separation pay. Kaso ung inooffer samin ng company is parang nawala ung separation pay. Question lang po nmin is prorated po ba ang separation pay? We've been with the company for 1 year and 4 months. Thanks in advance.

Yes, separation pay may be pro-rated.

You have been there for 1 year 4 months, so it is possible to receive only 1 month separation pay.
