I was accused of encashing a check, and was forced to sign because i was threatened that if i di dont i will be dragged by the police and be blottered, im not used to harassments like this i am just a regular person, should i just pay the amount for everything will be finished?

what will be better will be to request the bank for proof that it was not you who encashed the check. most have video surveillance.

I asked for a cctv camera but then they dont have it anymore they said it was already erased since it is only stored for 40 days

I am just a regular person and i would be willing to pay just so the issue will be finished but then i also want to clear my name. Whats your opinion on me paying just to stop the issue?

Is it legal that the bank concludes instantly as we went to the bank and asks about the encashment, i was hoping to see the cctv record but then they dont have it anymore.

bruno, it all depends on the evidence. aside from your written admission, what else do they have against you to prove you were the one who encashed the check? if it was encashed, then you should try to find the teller who handled the transaction and see if he/she will testify that you were not the one who did so.

if you are willing to face a case, then you should be prepared to face the consequences if probable cause is proven to hold you liable. there will be arrest warrants, your nbi record blemished, risk of conviction.

If i decide not to go through with the investigation, and just pay the amount will thay still have anything against me, should i have something for them to sign just to be sure i will not be held liable for anything else?
