Good day! I hope po matulungan nyo ako regarding this. We are from Catanduanes, si fiance ko po kasi ay nag-apply sa isang lending company dito sa amin last February this year, nagstart sila ng training ng March 3 sa Cam Sur, a day before iannounce sa kanila kung nakapasa sila sa training ay pinapirma na sila ng contract ng trabaho at meron doong nakalagay that if they will discontinue the job they are going to pay P27,000, he was assigned in Cam Norte, ayaw nya po magpatuloy dahil sobrang layo dito sa amin pro dahil sa takot na mgbayad ay nagpatuloy sya, 3 mos after he filed a resignation but it was not accepted instead he was reassigned sa Camalig Albay, and the Manager keep on insisting that he will pay the 27k, sa takot parin, dahil yung sinuweldo nya for 3 mos ay kulang pang pambayad, ay nagpatuloy pa rin sya. Ngayon po kahit hanggang 10:00 PM, Saturday and Sunday ay gumagawa sya ng paper works without overtime pay, hindi nga sya pinayagan mkauwi dito ng saturday to sunday kahit wala namang pasok. Ngayon po mahirap ang kalagayan nya kasi hindi lang ang katawan ang napapagodd, pati isip torture na rin kasi ayaw nya na sa isang bagay pro hindi sya makaalis. Please help us po, we need advice and we want to know kung legal ba yong kontrata na ganon or meron silang naviolate sa labor code. Maraming Salamat.

The contract is valid, because the company spent money in his training. Therefore, the fine included in the contract is valid also. But, the company also violated the labor code on the working hours. Employees should work for maximum of 8 hours only, beyond that, there should be overtime pay. Also, employees should work 6 days a week only, with 1 day rest. As for when is his rest day, depends on the company on what particular day of the week. Try to find out what is the minimum wage in the place where your fiance is assigned, if below minimum wage, that's another labor code violation.

If i were your fiance, just finish the contract, or save the 27k penalty and quit the job.

kahit po hindi pa nila alam kung nakapasa sa training at kung saan iaassign nung pinapirma sila sa contract? He was asking for the copy of it pero wala pong binibigay. Isa pa po sa nakakabother sa kanya kasi meron syang katrabaho that finished the 6 mos probationary period, she filed a resignation a month before that pero hindi daw tinaggap at pinagbabayad din ng 27k. policy daw po kasi sa kanila that even if you did not pass for regularization meron pang additional 3 mos continuation sa contract pero parang lumalabas na mag ayaw o gusto kailangan nila magpatuloy.

You might be entitled to have the contract voided and could leave immediately.

An employee may put an end to the relationship without serving any notice on the employer for any of the following just causes:

1. Serious insult by the employer or his representative on the honor and person of the employee;
2. Inhuman and unbearable treatment accorded the employee by the employer or his representative;

3. Commission of a crime or offense by the employer or his representative against the person of the employee or any of the immediate members of his family; and

4. Other causes analogous to any of the foregoing.

Sir Council, pwede rin po bang ireklamo sa NLRC kung may pang iinsulto o pang ha-harass ng ginagawa yung company? And valid pa rin po bang ireklamo yun kahit nakapag resign na ako? Thanks ng marami sir.

Kung nag resign ka na, malamang hindi na pwede i-reklamo sa NLRC. Pero kung meron kang katibayan na ihaharap, pwede ka magreklamo sa piskal o sa korte.

Thank you sir, meron pa kasi akong kasamahan na nasa kumpanya pa at gusto na magresign dahil sa maling pag trato oh pang dedegrade sa trabaho nya foreigner po kasi kaya ganun na lang makasalita sa mga empleyado, kung magrereklamo po ba sya ano anong katibayan pwede nyang gamitin aside sa pag testigo ko sa reklamo nya? Salamat bosss.
