i assume you or your spouse were residents there for at least 6 months at the time of filing of the petition. no, there is no internet based way to check on the status of your case. 2 months is still too early, give it 1-2 more.

atty i was married last 2008. In 4 years of marriage d namn po kmi ngsama on our own house kc im always out of the country ngwwork. It's like hindi po tlga nging mghusband and wife relationship nmin. He would just live with me sa house ng mom ko if dmdating me from abroad. Ayaw ko na po ng gnun. No growth and no plans sa side nya. I want to file annulment or nullity of marriage. Pwed ko po ba gnun ground yung ng kinasal kmi yung solemnizing officer which is a pastor,e hindi po name nya yung nksulat dun sa marriage contract instead sa ksama nyang pastor sa church kc yung license mismo nya is expired that time accdg to him. Could this be that my marriage is null and void from the start for the reason na expired yun license nya at hindi yung nksulat na solemnizing officer ang ngofficiate ng ksal?tnx po

Hello All,

I would like to get your advise on my situation. I received my Certificate of Finality last September 2014. I am getting married on Dec 2014 but will not be needing the CENOMAR as we are going to be wed in the Carribean in which they only require - birth certificate, passport and for me the certificate of finality.
My concerns are :
1. Would my second marriage be valid should I proceed to get married without completing first the registration? (the registration is on process now)
2. I am confused of what "Decree of Annulment" is... is this different from the "Entry of Judgment (Certificate of Finality) I received from the court?
As they said that after registering the finality to the Local registry and NSO - the court will issue the "Decree of Annulment"....

Please help.. Appreciate all your response on this matter!

God bless.

Andrea

i was married to an american citizen last 2003, after one year he left to USA and never come back until i never heard from him again till now. I really want to move on. Looking at the grounds for annulment, i dont think my situation falls in one of those. Abandonment is not a ground. What could i possibly do?

Even if you don't hear from him again, just look for ways to check whether he filed for a divorce in his country. If he is already divorced from his previous marriage to you, then you yourself may already remarry and move on from him. Divorce decrees are supposed to be available as public records, so it would not be impossible for you to look for a way to know.

Where a marriage between a Filipino citizen and a foreigner is validly celebrated and a divorce is thereafter validly obtained abroad by the alien spouse capacitating him or her to remarry, the Filipino spouse shall also have capacity to remarry under Philippine law. https://www.alburovillanueva.com/annulment-nullity-marriage

This rule is now recognized under the Family Code to avoid the unfair situation where the Filipino spouse shall remain married to the alien spouse who, on the other hand, may already remarry, as such foreigner validly obtained already a divorce in accordance with his/her own national laws. Please take note that only the divorce obtained by the foreigner spouse shall be recognized by law. Any divorce obtained abroad by the Filipino spouse shall not be valid and binding upon such Filipino.
