Good day po sa inyo. Hihingi lang ng advice tungkol sa situasyon nmin.Im working in a BPO company.But unfortunately will be termineted cuz of performance.May 29 was the last day ng dialnamin at pgpasok ng june 1 ay computation if papasa kami sa final last chance na binigay samin, which we fail.now they do heraing tuesday at sinabi na friday ung result ng process.Binigyan lang kami ng 3 days para gawin ung legal action namin.Tama ba yong ginwa nila or dapat mas mahaba ung bibigay nilang notice? pa help po

If this is performance then strictly speaking hindi kailangan ang hearing.

Performance evaluation is done before termination then processed almost immediately after.

Salamat sa reply.Kala ko kasi pede nila kami pa sweldohin muna before e term.Follow up nlng sir.kasi 3 yrs nko sacompany kahit BPO man cya entitle ako sa Seperation paydi ba..kasi sabi samin wla daw.

Dapat lahat ng araw na pinasok mo ay mabayaran.

Tama na walang separation pay pag na-terminate o kahit nag-resign.

Pwera na lang kung nasa contract o policy.

Did you have continued poor performance before this 'final chance' ?

Hi,

Good morning!

I'm still connected po company, nagwowork po ako as CSR for 9 months sa isang BPO company here in Ortigas.

Marami po kasi akong katanungan regarding Employees Right. Di po nag give company ng copy of JO and regularization letter even nag request ka katwiran nila ask muna raw sa Operation Manager which is naman po nafollow up na rin ng Team Leader ko para makuha ang copy pero wala pa po silang sineserve na copy. Pangalawa po is the medical card or HMO para sa amin employee. Until now simula nun naregular ako wala pa po silang issue katwiran nila is for renewal.

Absent po ako from work since May 28, 2015 until yesterday due to my bronchitis asthma. I was advised by Team Leader to go home last May 28, 2015 and personally talk to him that I am not well as he advised to secure medical certificate. May 29, 2015,I directly consult sa doc and doctor found out na my bronchitis asthma is acute excerbation need for confinement. Hinahanapan po ako ng medical card to lessen my expenses so I inform muna ang doctor na mag aask muna ako with my company about the HMO. I texted the Operation Manager about it na I was advised by my doctor for confinement as di pa po ako makapagpaconfine dahil hinahanapan ako ng med card as I follow up with him the status but unfortunately, wala po siyang reply. I send text message also with my Team Leader pero dahil bago po palang siya as TL wala din siyang idea with the status of the medical card. Napending ako sa confinement dahil sa wala po akong panggastos sa ospital and nag inquire muna po ako sa receptionsit ng ospital kung magkano ang gagastusin pag nagpaconfine ako sabi niya na kung gagamitin ang Philhealth card ko may mga portion na need kong bayaran in cash like mga gamot kaya nung nagpacheck up ako ulit sa doctor nun June 2, 2015 sabi ko po na wala pa po kasi akong pera pang paconfine so resetahan muna po ako ng gamot dahil baka makuha pa sa nebulizer .Pinafollow up ko yun med card ko at nag punta po kapatid ko office para igive yung 1st medical certificate ko. Everyday, nag memessage ako s Team Leader ko na di pa ako makakapasok as there is no specific date hanggat d pa ako nacoconfine. Last June 5, 2015, I personally report to office para pumasok pero pag dating ko doon is nahinihingal ako at kinakapos ng hinga dahil sa asthma ko. Sumadya ako sa HR para inform na nanghihina ako at nakita naman nila na di ko pa po talaga kaya na mag tawag or pumasok. Give ko rin po yung kanina yung 2nd medical certificate ko at itinanong ko na po sa officer yung satus nung medical card ang sagot lang po sa akin wala pa raw pong sagot ang Maxicare gawa ng pinaparenew daw po nila ang mga card at inask rin daw niya sa Management ulit ang feedback for HMO. I ask her if kahit HMO id para makapag paconfine na ako or paano if sa public ospital ako paconfine mairereimburse ba nila ginastos ko kasi tumatanggap lang sila ng med cert na accredited by Maxicare. I informed HR office na wala po akong choice is magpaconfine sa public hospital as itatanong muna raw niya about it at ang sabi lang po ay inform niya ang Management about my condition at nakita naman nila na di ko pa talaga kayang pumasok at ask niya s Managememt yung mga katanungan ko. June 6,2015 nag pacheck up ulit ako sa doctor pero I refused for the confinement due of lack of money so I asked my doctor if may referral siya para makapagpatransfer ako sa public hospital sabi lang po ng doctor deretso na lang po pumunta sa public without referral. I immediately informed my Tl na baka mag transfer ako sa public hospital at i gave information kung san ospital at baka Monday June 8, 2015, I directly went to Rizal Medical Center emergency room na admit ako sa ER gawa its a public hospital need to wait dahil maraming nagpapadoctor din at walang available room na ready pa kaya advise ng doctor na dun ako icure and give necesaary medication. I informed my TL about it but he message me if may plano pa raw ba akong magreport so sabi ko meron naman po kasi gawa rin naman ng pagkakapending ko dahil wala akong nakuhang response by company regarding sa HMO ko kaya ako napatagal sa confine at meron man akong hawak na pera di pa rin sapat sa mga gastusin at nakahagilap ako ng pandagdag ng monday afternoon lang. Nakalabas po ako kg ospital June 9, 2015 at give ako ng doctor ng medical certificate at di na naconfine dahil nacure naman po siya sa Emergency room with some laboratory na binigay sa akin ng doctor.

Nangangamba po ako kasi alam ko po na pagpasok ko mamaya baka bigyan nila ako ng Termination letter due to my absences at performance sa work. Ano po ba ang pwede kong gawin. Pwede ko po bang di pirmahan ang termination letter at mag seek muna ng legal advise. In case they serve a termination letter can i file a complain of not issuing medical card.Ano po ang laban ko at ano po ang dapat kong gawin?
