May anak po ako at ang last name na gamit niya ay hindi sa biological father. Nalaman nalang kasi namin na hindi pala ang boyfriend ko ang father after ng paternity testing na ginawa ng ex boyfriend ko. Ngayon po nagkasundo kaming 3 na i correct na ang last name ng bata.

1. Saan po ba dapat mag file ng petition? Kung saan po ba ang bata pinanganak o kahit dito sa Manila pwede mag file?
2. Ilang months po ba bago ma correct ang last name?
3. More or less magkano po kaya ang magagastos para mapag handaan namin ito?

1. Saan po ba dapat mag file ng petition? Kung saan po ba ang bata pinanganak o kahit dito sa Manila pwede mag file?

Ikaw ang magfafile ng petition. Ifafile ang petition sa place of residence ng anak mo.

2. Ilang months po ba bago ma correct ang last name?

It may take more or less a year because it involves court proceedings.

3. More or less magkano po kaya ang magagastos para mapag handaan namin ito?

It will involve proceedings, so you will need to hire a lawyer + costs in filing the petition.

For the court to determine the merit of the case, kailangan ayusin ang mga ebidensya tulad ng paternity test results.
Ihanda na rin niyo kung kaninong surname ang gagamitin sa mga bata kung sakasakaling magrant ang petition. Maaaring surname pa rin ng nanay na walang middle name, o ang biological father na dapat magprovide ng Acknowledgement of Paternity at Affidavit to Use Surname.

Tulad ng sabi ni Atty, may gastusin ito.
