May i ask if i am qualified from any crime if i failed to pay the borrow money from a 5'6 loan? actually it gets bigger every because of the interest.thank you very much

No One can be Imprisoned for Non-Payment of Debt

Perhaps you’ve heard someone making threats to file criminal cases against debtors who fail to pay. Yet you’ve heard the statement that no one can be imprisoned simply because of a debt.

Nasa Sec. 20, Art. III ng 1987 Constitution that "no person shall be imprisoned for non-payment of debt." Pero kung ang pag-utang ay may kasama o gawa ng pagtalbog ng kanyang tseke para kabayaran sa utang, panloloko upang makautang o pangeestafa, hindi pagbabalik ng pinagbentahan under trust receipt o paggamit ng credit card at pagtatago pagkatapos gamitin ito ay may karampatang parusa na kulong.

Under S.C. Administrative Matter No. 08-8-7 otherwise known as "Rule of Procedure for Small Claims Cases", ang isang utang galing sa pagpapaupa, pagpapahiram ng pera, serbisyo na ginawa, bentahan, sanglaan, kapabayaan o kontrata na ang sinisingil ay hindi lalagpas sa P100,000 ay pwedeng isampa sa Metropolitan Trial Court - Court of Small Claims kung saan gagawa lang ng complaint ang naniningil at agad na pasasagutin ang umutang.

Pagkatapos ng isang hearing ay magdedesisyon na kinabukasan ang korte sa kaso. Nasa Section 17 din ng rules na ito na bawal ang mga lawyer sa ganitong kaso except kung ang lawyer mismo ang nagsampa o sinampahan ng kaso
