is my marriage void or not

I've search the solemnizing license of the officer who took my marriage..i was married May 2007 but i saw his registry 2008.. is my marriage valid or not?

check mo if sya mismo naka name and signature na pastor sa mc mo. minsan kc. pastor ang nag cecremony pero yung ibang pastors ang nag sign kasi sometimes nga is expired ang lisc. it is normally happen even sa cristian church wedding. availability ng isang pastor for the ceremony pero ibang pastor ang pipirma. pero ok lng pag ganun. nasa usapan ng 2 pastor yun who will conduct the ceremony and who will sign.

as per article 80 of the civil code.

ang opinion ko dito, if in good faith kayo pareho ng spouse mo during the ceremony na empowered sya magkasal,
hindi pwedeng ibaling sa inyo ang kanyang pagiging peke para mapawalang bisa ang kasal,
as per article 91, dapat alam ng isa at itinago, pero kung walang nakakaalam na di authorized c officer,,,
parang ganito, pereng attorney,, nagpanotary ka di mo alam na peke,
di pwedeng maging invalid ang notary kasi peke c attorney..
di ko sure ah,, any expert advice..

ung pastor ung nkapirma s mc nmin pero pareho kming hindi kmi kabilang s sekta nila n christian.

it doesnt matter if member kau ng cristian comunity nila or church.
anyway. eto ilang mga grounds to consider a mariage "void from the very begining" o kasal na walang bisa sa una pa lng.
i believe base sa kwentong barbero mo:) eh may strong ground ka jan to consider your mariage void ab initio or void from the very begining:)


1. when a marriage is contracted by any party below eighteen (18) years of age even with the consent of parents or guardians

2. when a marriage is solemnized by any person not legally authorized to perform marriages, unless such marriage was contracted with either or both parties believing in good faith that the solemnizing officer had the legal authority to do so

3. when a marriage is solemnized without license, except those covered under Title I, Chapter 2 of the Family Code

4. when a marriage is bigamous or polygamous and not falling under Article 41

5. when a marriage is contracted through mistake of one contracting party as to the identity of the other

6. a subsequent marriage which is void under Article 53.

pero clarification lng ha? if ma review mo ang marital history mo at masabi mong may ground na mag sasabi na void ang kasal mo? hndi yun automatiko ha? you stil need a lawyer and file a petition to declare it void.

Please clarify, kasi ang alam ko, atleast 1 sa contracting parties should belong to the church of the solemnizing officer.
para magkaroon ng power/authority c officer to solemnize.

hanggat maari ay ganun nga sana according to article 7 of family code.
only the members are allow na maikasal under sa group of cristian comunity nila kung saang sekta sila kabilang.
ero hndi nangangahulugan na hndi sila maaring mag kasal ng couple na hndi nila ka miyembro. though, wlang profesional fee's ang sino mang pastor na mag kasal. and instead.. they call it "love offering" any amount is accepted kahit piso o isang libong piso:)
kasi parang charity daw yan basta ma meet ng partner ang requiremnts d2 eh maari nilang ikasal. sa isang banda, name lng naman ng church and ministry officer ang naka register sa sekta nito at hndi ang pangalan ng mga meyembro nito. kaya for him (pastor) hndi importante kung meyembro o hindi ng church comunity nila ang ikakasal. at dahil sa hndi naman kasama ang list of memebers sa registration ng church. hndi na ito naging basehan. dahil sa cristian, hndi ito gaya ng ibang religion gaya ng inc na may dcotrina bago ka maging formal na kasapi nito. sa cristian church ay minsan ka lng dito ay kabahagi ka na nito.

sa inc, jehovas witnesses, mormones, and trinitarian cristian church umiiral ang article 7 according sa law. kasi needs doctrine to be a formal members. unlike sa orthodox cristian i believe pina iiral din pero dahil sa welcome dito kahit sino at no need to memorized doctrines and consec attendance and some procedures to be a formal members. and i believe na sa orthodox cristian pastor sila nag pakasal. kung saan ang pag lapit sa pastor at pag hiling na mag pakasal ay indications and considering na sila ay member na nito.

ung pastor nirefer lng po..civil wedding ung ginanap s city hall ng paranaque..wlang seminar kming inattedan before the civil wedding and hindi po kmi hiningan ng cenomar

anyway tama yung sinabi ni landowner accroding sa familycode.

medyo confusing lng why pastor ang nag conduct eh sa cityhal naman pla ikakasal in civilway? may solemnizing officer naman sila dun?

better ipa review mo marital history mo and check if theres a posible ground na magagamit to declare your mariage void. but see to it na financialy fit ka and capable to hire a private lawyer for this.

valid ang marriage as per solemnizing authority..

then question na naman yong article 8( place to solemnize should be within the limits of the officer)

heheheh, confused rin ako bakit ang daming irregularities sa kasal nyo...

ngaun ko lng nirereview ung marital history..so i could have grounds to annul my marriage..btw thanks po s mga advise

clarification lng ha. iba po ang annulment sa decalaration of void mariage.

ang annulment po ay pag papawalang bisa ng isang kasal na may bisa at ayon sa batas.

ang voidable mariage naman po ay ang pag papa declare sa korte ng kawalan ng bisa ng isang kasal due to lack of requisites o maaring wla ngang bisa sa una pa man. at ito ay nangangailangan pa din ng utos o declaration mula sa korte upang ikaw ay maka balik sa stado bilang singleness and abeylabolness at handa na muling mag pa bola! este! mag mahal:)

in addition, lesson learnt na to ah, next time dapat alam mo na san ka lulugar, para madali kung sakaling file ka uli ng annulment or nullity of marriage.
buti na lang walang fruits of love, in a way affected cla dito..
