Hi,

I understand that this rule took effect last July 10, 2010.

I am a regular employee and I have checked and verified that I am qualified to avail this benefit according to the guidelines available in the www.ncrfw.gov.ph site.

I had my surgery last July 19. I tried to avail the benefit from my company and they said its not applicable yet, the company has not adopted to the rule yet due to lack of guidelines available.

Is this true? My company can refuse?

What should I do?

sec 21 states:
SEC. 21. Right to Housing. – The State shall develop housing programs for women that
are localized, simple, accessible, with potable water, and electricity, secure, with viable
employment opportunities and affordable amortization. In this regard, the State shall consult
women and involve them in community planning and development, especially in matters
pertaining to land use, zoning, and relocation.

i think you refer to sec. 21 of the irr, not the law. it states that the dole will issue further guidelines. you should inquire at the dole, bureau of working conditions. good luck.
