Hi Atty,

I would like to inquire if magna carta is taxable. I had my uterus removed last December and is eligible for Magna Carta. It was approved by my employer but I was advised that within the 60 days leave, Saturdays and Sundays would not be included so they just paid me 43 days and taxed it. As per my understanding of magna carta - "a woman employee shall be entitled to a special leave benefit of two (2) months with full pay based on her gross monthly compensation following surgery caused by gynecological disorders," they should have paid me the full 2 months and it is based on my gross monthly compensation so it should not be taxed. Is my understanding correct? I would appreciate prompt response on this.

It may be inferred that any of these benefits are subject to existing laws, rules and regulations so that may include taxation unless otherwise indicated.

But yes you should receive the 2 months pay (less taxes).

Basta naka-base kung ano man ang buwanang sahod mo.

No-work, no-pay ka ba?

Kung 15k per month, then 30k ang dapat ibigay, pero babawasan ng tax.

Gud pm! My query is, can the employee claim from SSS and at the same time claim from the employer under the magna Carta policy? Is SSS and MAGNA CARTA policy distinct to each other? that an employee can claim separately? Please advice...thanks!

I had hysterrectomy last December 22, 2014 and was entitled for Magna Carta by my employer. Just this March 22, 2015 I undergone another operation and my ovaries were removed this time. Will I still be eligible to avail for Magnacarta since as per my understanding it is 60 days special leave per year but my first Magna Carta would be due to my operation last December 22, 2014 though the 60 days overlapped this year.
