Good day po sa inyo! Hope ma advice po nyo ako sa aking mga tanong, nalilito po kasi.

Ako po si Ayel xxxxx. Nakabili po ako ng maliit na lupa around 500sq mtrs lang po this October 2010. Bali sa 20,000 sq meters na lupa ng Seller eh 500 sq. mtr lang po ang sa akin. Di pa po ito nabibiyak o tinatawag nila ipa survey. so far, ok naman po lahat ng papers, may Extra Judicial (may SPA etc.) at Deed of Sale na po ako, bukas po ipapanotaryo na sa abogado. Sa pagkaka alam ko po before 5th day next month dapat po bayaran ang Documentary Stamp then followed by other taxes. sa Tax Declaration po na hawak ko ngayun nasa pangalan pa po nila, latest po nabayaran ng seller was year 2008... mga tanong ko po.
1. Sino po magbabayad ng year 2009 at 2010 sa Tax Declaration, yung Seller o ako po na Buyer?
2. Anu po ba babayaran ko na tax para mapalitan o maisulat na ang name ko sa Tax Declaration?
3. Dapat po ba ako humingi sa Seller ng copy na prove na binayaran na nila ang Estate Tax?
4.Anu po ba requirements dapat dalhin kung magbabayad ng Documentary Stamp?
5. Do i need to bring a document or something na nag prove na nabayaran na ang Estate Tax ng lupa nabili ko kapag magbabayad po ako sa BIR?
6. Anu po ba requirements dapat dalhin kung magbabayad ng Capital Gain Tax?
7. After po ba mabayaran ng Documentary stamp tax,capital gain tax at ng tax dec ano-anu pa po ba ang babayaran?
8. Pagkatapos po ng taxes, anu po ba dapat ko actionan? as i said earlier hindi pa po nabibiyak yung 500 sq. mtr ko. Anu po ma advice nyo?

is this property under a title registered with the registry of deeds? are you dealing with just one of the heirs or all of them?

the property cannot be transferred to you without the first title being first transferred in the name of the heirs, and this cannot be done without payment of estate taxes first.

this sounds very worrisome unless you are willing to take on the risk.

babayaran pa po nila ang Estate Tax this month at naniniwala naman po ako kasi may bibili rin ng iba pa nila lupa worth 1.3M at doon po daw nila kukunin ang pambayad sa estate tax na 150,000.00 kasi yung full payment ko sa kanila eh maliit lang po 225k kaya doon sila kukuha ng pambayad sa Estate tax sa payment na 1.3M... nagkataon po na magkasabay kami bumili. bali mga heirs nalang po ka deal namin kasi patay na original owners and parents nila... bali mga anak sila at mag pipinsan..may SPA naman po.

anyway, if you have trust in them, you should only be liable for real estate tax after you purchase the property unless you agree to pay for arrears. be aware that your purchase cannot be registered on the title or the Tax Dec until the estate taxes are settled first, and then the taxes for your own purchase is paid for.

i would advise you to be very careful because you are dealing with someone who is not the registered owner. to be effective, the SPA should be inscribed on the title, but again that cannot be done unless the title has been transferred to the heirs.
