Is the Employee going to Jail?

Arresto Menor

A company has been transferring from one RDO to another, and has been on-going for 1 year now.
The company does not pay the employee's taxes, and was told just to hang-on until the transfer of RDO is done.

The employee decides to resign.

The other company which he/she will go after, requires ITR. Now, ITR is requested by the company from BIR (right?)

But the Company can't provide ITR.

How should the employee proceed?

ITR is generated by the company and submitted to BIR.

Tell the new company that his/her previous company does not provide ITR

Would there be a problem transferring records?

Would the BIR go after the employee because he did not pay his taxes for the past year? Or would they be after the employer?

employee would still be liable for taxes whether or not the employer withheld or remitted taxes

What should the employee do? Pay all the held taxes in one go? Wouldn't that kill the employee per se?

yes. paying taxes has never killed anyone. that is the only way to avoid personal liabilities. you may try to appeal to the bir, they MAY compromise with a deferred payment scheme
