Dear Lawyers,

Our company intend to promote 2 of acting supervisors to full-time supervisors. However, our boss is thinking of not adjusting their basic salary but give allowance instead for the promotion.

Is it legal to stipulate in the Personnel action form that such allowance given is for the position of Supervisor only.. and that if comes a time the concern supervisor be transferred to another position, lets say Warehouseman, or be demoted back to being an ordinary production staff, said allowance will no longer be provided??

Pls guide us..

Wala naman sa mga batas o patakaran at regulasyon na kailangan ng adjustment ng sweldo. Tanungin mo sa HR ninyo para sigurado.

Allowances, except for general benefits, are usually attached to positions or jobs not to persons. So it is right that they change if the employee is assigned to a different position.

Is allowance or tax shield computed based on work days, or allowance will be released on fixed rate? Example if allowance is 12k based on contract, is it given 6k every 15 & 30th? how about if the employee has 2 days absent, what would be the computation for allowance. "This is not COLA, only allowance indicated on contract," Thanks
