gudmorning po.. ask q lng po kung entitled pa din po ba sa 5 days leave ung ksamahan q..

6 yrs na po sa company.. nag maternity leave po xa starting October last year..Hindi pa po ulit xa nagreresume ng work..tpos po, hinihingi po nya sa office nmin ung payment sa 5 days leave nya kc hndi pa nman po nya ngamit un .. ang sabi po sa knya ng co. ay wla na dw po xang makukuha dhil hndi nman dw po kumpleto ung taon na pinasok nya last year.. wla na po b tlgang mkukuha na 5 days leave ung ksamahan q??

I started working at a BPO company last February. I was then regularized last August. Upon regularization, I thought that I was accorded the automatic 5 days Service Incentive Leave as per Article 95. Right to service incentive leave, wherein it states "(a) Every employee who has rendered at least one year of service shall be entitled to a yearly service incentive leave of five days with pay." However, I found out that I, including my batchmates who were also regularized on the same month, were not given the 5 days SIL and instead, were only accorded the 1 day SIL per month moving forward from August.

Did my employer violate Article 95 of the Labor Code? Anf if so, what are the steps we could take to remedy this?

Check your company policy regarding leaves first.
