When can I sell a property if its under deed of donation?

Hi All,

Our property title was transferred to us through deed of donation, we're planning to sell the property. However, we are unsure if we can sell the property already knowing that the property was donated to us less than 5 years.

I think there is a law that a deed of donation can still be cancelled by the donor from the donee for some reasons while donor still alive. I think after 10 years from the donor's death that the donated property can be disposed.

please help, may binentang parte ng bahay at lupa (half of it) ang kasera ng auntie ko sa kanya. pero dun parin sila nakatira sa bahay at lupa dahil nasa ibang bansa ang auntie ko.walang kahit na anong kasulatan na ngpapatunay ngyon po gusto na ng auntie ko ipaayos ng naaayon sa batas. pano po ba ang gagawin namin? ano po ang step by step para maayos namin? kailangan po ba muna ito ipahati sa land registration bago gawan ng deed of sale? pano po ang gagawin sa pghahati? thank u po

with due respect mam, kaya nga ako nagtatanong anong legal basis mo . ilan thousands kaya ang provision ng civil code at ilang libo din ang supreme court decisions. kaya nga tinatanong kita anong legal basis mo nung sinabi mo na:

mahirap ho magbigay ng opinion if hindi mo alam ang batas mam. kasi sila nakadepend sa iyong opinion.

Tama ka napakaraming batas, kaya hindi ko rin masabi sa iyo kung anong exact provision ng civil code, kasi hindi ko naman alam kung bakit na-donate, anong conditions nila ng donor, ano ang isinasaad sa deed of donation,etc. kaya nga sinabi ko "each case has its own merit", di ba? Kaya nga sabi ko sa iyo, mag-research ka sa mga supreme courts decision para makita mo rin na minsan ang sinasabi ng batas ay nagiiba pagdating sa mga ebidensiya, circumstances, etc. Shallum!!!
