Good Morning po. May naiwang lote po ang lola ko. 11 po ang anak nya, 8 ang buhay at 3 po ay patay na din. ang lote ngayon ay nahahati sa 4 na parte. ung 2 parte po natitirikan po ng bahay ng 2 pinsan ko (bale anak po sila ng panganay na anak ng lola ko). ang sabi daw po ibinigay daw po iton ng lola ko dun sa panganay na anak. wala na po nghabol although wala namn po kasulatan. ung 1 parte po, nagtirik po ng bahay ang tatay ko (patay na din po). sa akin po naiwan ung bahay. ngayon po pinababayaran saken ng magkakapatid ni tatay ung kinatitirikan kong lupa. ung isang parte po vancant po, kumbaga ipinagbibili din sa kung sinong gustong bumili. pumayag po ako magbayad sa kanila, pero wala po sila maipakita saken titulo. nawawala na daw po. sabi ng mga kapatid ng tatay ko.. pirmahan na lang daw. pagawa na lang daw ako ng kasulatan sa abogado tas pipirmahan nila. Legal po ba ang ganung solution?
Ang gusto ko po sana mangyari is ipaaus mismo ang titulo, kaso ang dami po palang kelangan at worst sigurado din po ako na ako ang gagastos para maaus ang titulo. ang pagkakaalam ko po, nakamother title pa at hindi pa naililipat sa mga anak.. 32 years na pong patay ang lola ko.

Puede mo naman itanong sa register of deeds kung saan located ung lupa para malaman kung ito'y nasa pangalan pa ng lola mo. Opinion ko kung nakapangalan pa sa lola mo, gumawa na lang silang tagapagmana ng extra judicial settlement at ung mga heirs ng mga kapatid nilang namatay na ay depat kasama sa Extra Judicial Settlement. Kung ito'y gagawin medyo kailangan ang big funds lalo na kung hindi nababayaran ng amilyar at estate tax plus transfer tax. Siguro ung pagpapatitulo sa kanyakanyang parte ay kanyakanyang bayad na lang. Iyong amilyar, transfer tax at estate tax ay paghahatian ng lahat. Nung namatay nanay naming 10 children ay 13 yrs. na nakaraan ng mamatay si tatay. Naging problema namin din ang ganyan at EJS ginawa namin. Ung isang bakante lote ibinenta namin para may pambayad kami sa amilyar, transfer tax, notary public at estate tax (13yrs w/high penalty). Pinasubdivide namin sa 10. Well good luck!

The cost depends on the class of property, the size, the fair market value, zonal value, selling price, and others.  If I know the description of the property stated on the Tax Declaration at kung kanino nakapangalan ang titulo, I can give you some idea, however, you will encounter a serious difficulty if the titulo is in your lola's name, you will not be able to register it in your name, aside from petitioning the LRA to issue another title in lieu of the lost one (you need a lawyer on this).  Additionally, if property is in your lola's name, you cannot register it either in your name without an ExtraJudicial Settlement or Judicial Settlement and Estate Tax is imposed also. Neither a Deed of Sale between  you and your tatay's siblings will be valid.  Deed of Sale is between the buyer (you) and the seller (person named on the title).  Consult a lawyer, masalimuot masyado ang case mo.  Good luck!
