I am hoping to seek legal advice on my problem. I have received a letter from a company that they will be pursuing a case against me for falsifying their company analysis report.

Will I be going to jail because of that? or how much would it cost me to settle if the cost of the document falsified is around 10,000. And is it posibble to have my business permits cancelled if the company files a formal complaint with DTI and our City's business licensing office.

Please help and let me know how can I go about this.

theres no crime of "falsification of private document".... only falsification of public document can be falsified..

In what way did you falsify the company analysis?? Whats the content of company analysis??

The company is a testing laboratory that provides various services. Couple of years back I hired their service to test a specific kind of plastic material to check whether it is hazardous or not. Such procedure is part of my business' compliance with DENR.

Recently, DOST required me to submit the same analysis report with them but it has to indicate current year on the analysis report. I find it redundunt and will be a waste of money to acquire the same analysis report since it will only reflect the same analysis from the one I got couple of years back. So we just changed the date on the report we had way back and submit it to DOST. Apparently, DOST verified the authenticity of the report to the company and found out that the report was falsified.

The CEO then wrote a letter stating that they will be forwarding the issue to their legal counsel. And will probably resort to reporting our business to DTI to have our permits cancelled and revoked.

What will be the possible remedy we can arrange?

Your response will be highly appreciated.

I wrote the CEO a letter stating that I deeply regret what happened and the falsifaction that transpired was done without my knowledge. And that such act will not be tolerated. I posed an alibi that it was my representative who committed the falsification and incidentally I really have a representative who plagiarized some of my business and personal transactions. Whom at this point I have no communication whatsoever and she was able to get away with a hefty amount of money. I also guaranteed them that I am already working on getting an authentic analysis report from their company to rectify the incident. (which is true)


Two weeks passed and I haven't heard from their legal as of yet and I am afraid to wake up one morning that I have lost my elegibility of doing business.The cost of the falsified document was only around 10K.I have no idea how much money they are going to ask for remedy. You think 25K is reasonable enough? Or it should only be the cost of the falsified document plus attorney's fees. Or you think my alibi was enough to keep them from filing charges against me and my business?

Really appreciate you taking time to read my predicament. Its good to have have somebody I can discuss my problem with who is more knowledgable with the law than I am.
