Hi! I was hit by a firework last January 1, this was from our neighbor. I visited the hospital and was given tetanus shots and they cleaned my wound. After 7 days, the wound did not heal and I visited another doctor, and was recommended to undergo a foot surgery. The surgery left a hole in my left leg and I am still recuperating from it. I missed work, and my little business was not attended to since I cannot stand for long or sit. The neigbor shouldered my hospital bill amounting to 83,000.
The wound healing as per my surgeon will take 1.5 years considering that i am diabetic.
I would like to ask for your advise regarding my legal rights as the offended party. Can I claim for my lost income since I was on a no work no pay status? With regard to my small business, can I claim for lost income for that still? What about follow up visits to the doctors, medicines? And they say I can claim for the "inconvenience", wounded feelings, sleepless nights which I don't know how to quantify monetarily. Hope to hear from you soon!
