Petition for Nullity

Hi Atty. good day everyone. I received a summon for Declaration of Nullity. I have no plans to contest but my question is the possible technicalities in the legal procedure. My soon to be ex is working abroad yet he affixed his signature in the petition stating he signed the petitions here in the province and the atty. had also affixed her signature stating it was signed in her presence. Isn't this fraud? Let me know what could be the possible liabilities of this people if I question their fraudulent act?

Im so sure my husband was abroad on the date he stated he affixed his signature.

If you are not contesting the petition, what is point of asking this question?

Im concerned about the validity of the petition since its obvious that it was fraudulently prepared. Will this have an infact in the outcome if somebody other than me will question this?

Additional concern: I am filing an RA9262 early Jan. inunahan lng ako ng mister ko na mag file ng Nullity of Marriage kasi nabuking sya na may mistress. Theyre both OFW at present. I am not anymore interested in working out our marriage thats i said im not constesting sa nullity but wanted to make sure this is done properly pra wla nang further problems later.

Anyway yung case ko against him is psychological and economic abuse. Wla bang impact ang on going petition for nullity kong mai file ko na ang RA9262?

Walang impact yung petition ng husband mo sa case mo laban sa kanya.

Annulment and RA6292 is a separate case, he filed an annulment and you filed an RA9262 therefore its separate case and will not conflict his petition against your complaint! Make sure to obliged him to give your children maintenance if any, until they finish college as an agreement if he want to avoid imprisonment. Even if he managed to get the annulment granted he is still obliged to maintain your children.

Allow po b sila maikasal khit hindi annulled ang kasal sa una at pwede nang basehan ang pirma gawa gawa nila?

Hindi po pwede yun, pwede ka makasuhan ng Bigamy which is a criminal case.
