Hi po ulit sa lahat.
Ganito po kasi ang scenario.

Si A (aged 16) ay nagpakasal "daw" kay B (aged 21) ng 1968. Nagsama lang sila for 3-4 months at iniwan na ni B si A habang buntis kay Baby 1.

"daw" dahil walang pinanghahawakan si A na marriage contract. Ngunit noong 1986, gumawa siya ng affidavit, na nagsasabing COMMON LAW RELATIONSHIP lamang ang meron sila ni B for 3-4months, at 14yrs na silang hiwalay nang siya ay kinasal kay C. Ang gamit na apelyido ni A ay kay C since. Nagkaron sila ng anak na si Baby 2 at Baby 3.

Namatay si C 1989.

Nang 2001 nagpakita bigla si B (nalaman sa probinsya ang kinaroroonan ni C sa Manila), para lang naman humingi ng tawad sa nagawa kay A, dahil biktima ito ng domestic violence noon (dahilan ng kanilang paghihiwalay).
Bumalik din siya ng probinsya at nabalitaan ni C na doon na ito namatay that same year.

Nagkaron ngayon ng property si A noong 2005.
Namatay naman siya noong 2013.

Ang tanong po:
1. Sino kina Baby 1, Baby 2 at Baby 3 ang mga Legitimate/Illegitimate?

2. Si Baby 1 ay nagsasabing may pinanghahawakang kasulatan na kasal talaga si A at B (hindi rin sigurado kung ito'y tunay. hindi galing sa NSO dahil kasal kay C ang lumalabas pa rin sa NSO base sa CENOMAR).
Ngunit nasabi ko po sa taas, na may ginawang Affidavit si A na nagsasabi namang live-in lang sila ni B.
Alin po ang magiging valid sa 2 kasulatan?

3. Ano naman po ang magiging bahagi ni Baby 1 kung sakali sa property ni A sa ganitong situation?

1.
Baby 1's status as legitimate or illegitimate is dependent upon whether or not A and B were married. To trace this, we can look upon baby 1's birth of certificate as issued by civil registrar or NSO.

Baby 2 and 3 are considered as legitimate child of A.

2.
NSO document is the best evidence to solve the issue on document representing marriage between A and B vs. Affidavit executed by A.

If the NSO records shows that A is Married to C, therefore baby 1's claim is untrue.

3.
IF baby 1 is Illegitimate child, his share over the A's property is 1/4 of the share of 1 legitimate child.
