attyLLL,

I'm about to resign to my current job and I am planning to submit my official resignation letter with 30 day notice on the 1st of December.

I know my employer will definitely withold my last pay (for Dec 30) but I was wondering if it is lawful if they widhold my 13th month pay and salary on the 15th of december.

Thanks for your advise.

What does your company policy say regarding resignations?

@council
Thank you for your response. I will check my hand book if I still have it. Are you saying that it all depends on the employer that there is no legal ruling about/related to this?

argue that 13th month is not last pay, and should be released
