Regular rate, depending on amount you receive, since it is still part of your income.

If it is not taxed, you are obliged to report the same income to your next employer for proper taxation.

Can the RMC 39-2012 be applicable? it requires 5% only instead of the regular 32%

This is for garnishees such as banks and others who hold assets of the employee which will be used to pay the employer.

Any amount received by the employee should still be taxed accordingly.
