The scenario is our company has attendance policy which is point system and should pass through progression (From coaching, verbal, written, final to termination).
Operations is following this process but lately, HR has a project called "ZERO attrition and LABOR complain". With this, we notice that the process of removing people even we passed all due process become slower and it came to a point that operations want to terminate someone because of attendance and insubordination issues but HR staff let the employee resign instead of terminating him/her. To make the story short, the process of achieving ZERO attrition and LABOR complain is going on a different direction NOT alligned with the operation. In fact, HR decided to just let the employee resign without consulting the operations management because the reason is they say the employee might complain in NLRC.
Few questions are:
Is this legal?
is HR the final say when it comes to business decision?
Can we sue the whole company for having this kind of attitude / process?
